Man sentenced to prison in disabled son's death -- chicagotribune.com

A southwestern Illinois man who admits he killed his deaf, disabled 2-year-old son in 2007 should spend the next 44 years in prison.

That's the sentence a Madison County judge handed Tuesday to 24-year-old Johnny Garcia of Alton.

Garcia pleaded guilty in May to a first-degree murder count in exchange for a promise of no more than 50 years in prison.

A pathologist testified that toddler Maxwell Eyer sustained four fatal blows to the head Dec. 27, 2007, several hours before he died at a Missouri hospital.

The child's mother, Linsey Eyer, also is charged with murder in the case.

Associate Judge James Hackett said he found the way the baby was treated "difficult to comprehend" and "unbelievable."
