Man gets seven years for killing deaf pedestrian | The Columbus Dispatch

A Columbus motorist who passed out at the wheel of a minivan was sent to prison today for seven years for killing a deaf pedestrian on the Hilltop.

David M. Johnson, 30, formerly of Sofia Court of the West Side, pleaded guilty in January to aggravated vehicular homicide.

Columbus police said Johnson was driving west on Sullivant Avenue when his van ran onto a sidewalk east of Crescent Road and hit Fiery Hayes from behind, killing him, about 12:45 a.m. on July 31.

Police later learned that the 43-year-old Hayes was deaf and could not have heard the van coming his way.

Johnson's attorney, Christopher Junga, said painkillers had made Johnson drowsy.

Johnson, who was in Franklin County Common Pleas Court, apologized for the wreck before Judge John F. Bender. The sentence Bender gave him was one year shy of the maximum.
