Is he hogging water or is it legal?

Oh no, not another BS government doing their own tyranny business! I can't believe the town decides all source of water belongs to them automatically, wow what a greedy town government they are?

That's a lot of water though. He had three large reservoirs. No I don't think they should have locked him up but I see their point. It's like allowing someone to dam a river on their property thereby depriving everybody downstream of their water.

I agree though... it's just rain water. It's like locking somebody up for breathing too much oxygen.
 
I believe what they had a problem with is him building dams without permits. It is not fact that he is collecting water but that he is building dams to stop water from following it's path preventing those downstream from enjoying the water.

I think that is what is causing alarms with officials.

As for his right to do so or not.. I don't know which is right or not.

It depends on what that purpose of that water is being used for. If that land area in Oregon relies heavily on rainfall+sewage in wastewater treatment plants, that water can be designated to farms or essential for environmental ecology where they don't need to use higher quality water. It could also pose health risks. I just realized since it's stillwater, it can be breeding grounds for mosquitos and other organisms like N. fowleri which is bad news.

I'm going to read more into this before offering a solid opinion on it.

Just one nitpick, this is Oregon state government, it doesn't represent the rest of US. I would think in a place like Hawaii they could care less.
 
He had permits to build the ponds and then the state took them back. Unless there was fraud in the application ,why should he have to take finical the hit on building and then tearing the dams out?

-however there is more to it than what has been discussed. He was _diverting_ water from a stream to which he did not have water rights into his ponds. That was in the original article I saw a couple weeks ago. Was warned repeatedly.
