Suspect arrested in actress killing

NEW YORK (AP) -- -- A man was arrested Monday in the killing of an aspiring actress during a holdup on Manhattan's Lower East Side, a once-gritty neighborhood now known for its hip nightspots.

Rudy Fleming, 19, faces charges of murder, robbery and weapon possession. Authorities did not immediately comment on when he would be arraigned or whether he had a lawyer.

Nicole duFresne, 28, of Brooklyn was shot during a crime spree by Fleming and some friends, police said.

Earlier, the group tried to rob a man at gunpoint, but he fought off the attackers, police said.

About an hour later, duFresne was leaving a bar with her fiance and another couple when they were approached by the group, one of whom demanded money, police said.

Witnesses told investigators one of the assailants grabbed for the purse of duFresne's friend and the actress said, "What are you going to do, shoot us?" One of the men then fired a shot.

BOSTON -- Police are questioning three teenage suspects who admit they were at the scene of the murder of an Emerson College graduate last week in New York City.

NewsCenter 5's David Brown reported that Nicole DuFresne, 28, of Brooklyn, N.Y., was murdered Thursday during a botched mugging.

On ABC's "Good Morning America" Monday, the family of the aspiring actress and playwright spoke about the sister and daughter they loved and worried about.

"I worried about Nicole all the time. I think that is what mothers do. New York is a big city and, sure, sure I worried about her," said Linda DuFresne.

Her mother's worry didn't stop DuFresne from pursuing her love of the theater. Her mother said she knew New York would eventually come calling.

"This is where she felt she needed to be to expand her theater experience, and she felt the opportunity was here. She had been in Seattle for some time and did very well, and I think that prepared her in her mind for New York. She wasn't afraid to do that," said Linda DuFresne.

A surveillance video shows the suspects about 10 minutes before the mugging. DuFresne's brother, Zachery, said he is thankful the police have a suspect.

"I feel blessed. I had her for 25 years in my life. She is so remarkable. She changed me, who I was. I wouldn't be the person I was today with out her. I'm very thankful," he said.

Family and friends had a memorial service Sunday night in Seattle, where DuFresne lived before moving to New York.

Another reason i hate the police. They give bad advice. An officer told me if youre ever approached by an armed robber give him what he wants ""He will not harm you if you cooperate with the robber he will not hurt you cause the robber wants things to go smoothly with no trouble"" Thats bullshit now...THIS IS WHY WE NEED VILGANTE JUSTICE .... Police and the Courts are not doing their jobs. The only people who can over ride the police is the governor or the mayor. The Governor and the president of the united states can fire judges. Like Jeb Bush Governor of florida did after he heard the sex offender was let go of a parole volation by a judge who refused to sent him back to prison because he volated his parole and the sex offender raped and killed 14 year girl in tampa. So Jeb Bush Fired the judge The Mayor of Miami Fired the police chief because of the elian gonzalez situtation. We Need to take the laws into our own hands. Like heres my suggestion for that girls family to do. Attend to her murderer trial the day of the verdict take a gun with you just in case it doesnt workout. Wait for the verdict If the jury says guilty and gives him life then great. But if the jury says not guilty by reason of insanity Leave the courtroom go out the hallway wait till her murderer comes out and then you shoot him in the head. Of course youll be arrested by you did instant justice for your daughter. So that way the murderer would be 6 feet in the ground just as your daughter is. So the murderer isnt gonna have a privelge eatting 3 meals a day cause your daughter isnt eatting 3 meals a day cause shes dead. So i support VILGANTE JUSTICE cause its the only way justice would be served.

and if you shot that person, and but if he turns out to be innocent...

Look a John Hinkley. He got away with almost killing the president. Its the lawyers dude THE LAWYERS! A defense lawyer will do anything to get his client off the hook. Look at O.J Simpson Its his defense team got him off the hook and he was found not guilty by an all black jury. Blacks will never convict their own cause blacks look at their people as brothers and sisters even they didnt know the guy. Its Johnnie Cockran who wanted the jury to be all black because he knew he would get a not guilty verdict. Same way with robert blake he will get off the hook because his lawyer wants everyone to be italian on that jury cause italians look at other italians as brothers and sisters too. Ever watch the sopranos? If you watch the sopranos you get a general idea about how italian families work.

NYC Actress' Slaying Teaches Hard Crime Lesson

NEW YORK (Feb. 4) - As an actress, Nicole duFresne had roles in dozens of way-off-Broadway productions.

But it was an unfortunate real-life line witnesses say duFresne uttered before her slaying - "What are you going to do, shoot us?'' - that has brought her to the public's attention.

Authorities have refused to speculate whether the 28-year-old actress and playwright's defiant stand against a bandit prompted him to shoot her to death last week on a New York City street.

Safety advocates, however, have cited the case as a lesson in what not to do during a holdup.

On Wednesday, the Washington-based National Crime Prevention Council responded to widespread reports about duFresne's last words by circulating a list of tips on how to survive a mugging.

"It demonstrates that confronting an attacker is probably the worst thing you can do,'' said council spokesman Todd Post.

DuFresne, a Minnesota transplant whose Internet resume listed "stage combat'' as one of her skills, was leaving a bar with her fiance and another couple at about 3 a.m. Jan. 27 when they were accosted by a group of youths who had already tried to rob another person earlier in the evening.

Witnesses told police that when the group demanded the other woman's purse, duFresne responded with: "What are you going to do, shoot us?'' Police said she also may have gotten into a brief shoving match with the shooter before he fired a bullet into her chest.

"The ferociousness with which she always protected her friends never surprised me, especially in that moment,'' fellow actress and friend Mary Jane Gibson said before a memorial service Thursday.

Police arrested the alleged triggerman, Rudy Fleming, 19, and two teenage girls they say took a cell phone and credit cards and helped hide the murder weapon. All three have been charged with murder and robbery.

DuFresne's fiance, Jeffrey Sparks, his face still bruised, told reporters Thursday he didn't see his fiancee get shot. But he heard the gunfire and turned to find her on the ground.

"I ran to her and held her and begged her to hang on,'' he said as he began to cry.

Sparks said he regrets he "didn't take her hand and pull her down the sidewalk away from that idiot with a gun.''

Servisio Simmon, 21, a member of the group of youths who was taken into custody but released, gave a different version to The New York Times.

Simmon claimed duFresne told the alleged triggerman: "You got what you want? You got what you want?'' He also said the actress "kept raging after Rudy, she kept pushing him, she slipped over the snow'' and that the gun "went off.''

Police declined to comment on that account.

On its tip sheet, the crime prevention council advises potential victims to stay cool and comply with robbers. At the same time, people should take mental notes on what the assailant looks like so they can provide a detailed description to police, the sheet says.

A robbery "is more about power than anything,'' said Alfonso Lenhardt, president of the nonprofit council, known for its McGruff the Crime Dog mascot.

"It's a tragedy, but in this case it sounds like (the suspect) felt he wasn't getting the respect he was due,'' Lenhardt said. "When a gun is in the hands of a desperate person with low self-esteem, they're going to react that way.''
