Deaf boyfriend cleared after apartment row - Courts, News - Herald.ie

A DEAF ex-council worker was arrested for trespassing outside his girlfriend's apartment in a drunken episode after she told him he was not welcome there following a row, a court heard.

Jerry Allen (59) was taken into custody when he became aggressive towards investigating gardai and refused to leave the apartment complex.

The father-of-two was left without a conviction after he pleaded guilty to a charge of criminal trespass and made a €300 donation to charity.

Allen, of Lower Mount Pleasant Avenue, Dublin 6, admitted the offence, which happened at Waterside Apartments, Ringsend Road, Irishtown on July 8. Dublin District Court heard gardai were called to the apartment after it was reported that a man was threatening the occupant.

Banging

Allen was found in the hallway of the first floor, banging on the door. He was in a "highly aggressive state and under the influence of alcohol".

The apartment occupant said she was Allen's ex-partner and he had no permission to be there. He refused to leave and was arrested.

The accused's girlfriend, who he had been with for five years, was in court to support him.

On the day she told him he was not welcome there after an argument and he went drinking. The court heard he had been on medication and normally only drank socially with his girlfriend.

He lost his hearing when he fell down steps at Bray Dart station in an accident in 2007.
