ONE of the six suspects accused of murdering former Isiolo Catholic Bishop Luigi Locati has gone deaf, Kenyatta National Hospital confirmed.

In the wake of the development, the High Court ordered corrective ear surgery be conducted on the Mohammed Dika Wario within 15 days.

A Dr Masinde of the Ear, Nose and Throat (ENT) department conveyed the report on Wario to Justice Muga Apondi who on January 14 ordered the hospital’s Medical Superintendent to furnish the court with the same.

Wario, through his lawyer Joel Mbaluka, claimed he was allegedly tortured by police when he was arrested and has since gone deaf.

Mbaluka and another defence lawyer Ojwang’ Agina had complained that the six suspects were tortured by police and called for a medical report to the effect.

Dr Masinde availed the report, which stipulates that the suspect has had a five-month history of hearing loss.

He recommended that the suspect undergo a corrective ear surgery to enable him follow the proceedings during his trial for the alleged murder of the prelate on July 24, 2005.

Justice Apondi ordered the Attorney-General Amos Wako to ensure that Wario is operated on within the next 15 days.

The judge directed Dr Masinde in conjunction with KNH to conduct the operation then file a report to the court.

The A-G was further ordered to provide hearing aid to the suspect to enable him follow the testimony to be adduced against him.

The cost of the hearing aid shall be met by the Government.

A state counsel Ms Rodah Amulele informed the judge a similar medical report on the five others had been released but was not in the court file.

Justice Apondi directed that the report on the other five suspects - Father Guyo Waqo Malley, Mohammed Molu Bagajo, Aden Ibrahim Mohammed, Mahat Ali Halake and Roba Balla Barichi, be availed within 15 days.

Walley, Bagajo, Mohammed, Halake, Barichi and Wario are charged with murdering the Isiolo Catholic Diocese Bishop Locati on July 24 2005.

They have denied the offence and their trial has been fixed for May 2, 2006.
 
He probably stuck his ear in a subwoofer at full blast hoping to delay the court proceedings. ;)
