Statuatory rape is not chargeable if both the participants are minors.

Statuatory rape generally does not become a charge if the younger one is 16. That varies by state, but the vast majority of states have 15 or 16 as the age of consent. That is the determining factor. The younger partner must be below the age of consent, and the older partner must be at least 18.

Keep in mind also, everyone, that banning sex offenders from sites would only be applicable to the offender that has been charged, found guilty, and forced to register. The ones that haven't been caught yet would remain a danger and permitted to surf these sites.

Banjo's solution is much more easily applied. Know where your kids are visiting and to whom they are talking.
 
I was reading an article about this a few years ago about a married couple that both had to register as sex offenders. They were caught under the age of consent. They are in their 30's and married but because of the way the law is in Georgia, if they decide to have kids, their kids will be taken away (they cannot be around minors).

When a statuatory rape charge cannot be levied because of the age of consent, they can still levy a gross sexual imposition charge and that is still an offense that one would have to register for.
 
I think the Ga. Supreme Court Justices should focus primarily on predators. Also, Atlanta has a very dangerous gang problem. 3 major Mexican drug cartels are staking territory here and the gang population has moved to the suburbs.

There have been a rash of home invasions to accompany this. Why aren't gang members required to participate in a "regulatory non punishment registry"?

I would feel a LOT safer if I knew where the dangerous and violent offenders were.
 
How could they enforce something like that? If it isn't connected to a crime committed and found guilty of, how could you determine who has to register and not register?

That's my problem with this idea of banning sex offenders from sites. There are those sex offenders who haven't been arrested out there and in many cases we won't know for sure if they're one till they're caught.

Banjo's idea is much better and much easier to enforce.

It's not gonna kill you to spend a few minutes to look them over before deciding whether or not their membership request is approved.

MySpace is loaded with RSOs. If anyone comes across them being a known RSO, they can inform the webmaster of it and they can delete their MySpace account.

Perverted-Justice has a dedicated team that do just that and thousands of RSOs has been deleted as a result of their hard work checking them out. Most of them are tracked from pedophile websites and it's not that hard to track them to other websites and observe their behavioral patterns before determining whether or not that their presence at the website could be a treat to other underage users.

Registration is automated. Has been for years... on every networking medium (BBS, chat software, social networking, MMORPGs and so on) even before MySpace. I know this as a former owner of a vBulletin license.

No one actually check the profiles...

Why would you want to go through a thousand profile a day?

You first go to a RSO site, then go to myspace and type in their names found in the RSO database, if not found easily, do various combinations to see what the come up with such as first initials and so on.

Also they check usernames to see if it matches up to already known usernames that frequents in a pedophile message board.

It's not 100% foolproof, but it helps.
