Autistic Boy Set On Fire At Sleepover

LAWRENCEBURG, Tenn. – James Whalen, 12, is suffering from third-degree burns on his face and neck area with less serious burns on other parts of his body, after a teen doused him with cologne while he was sleeping and set him on fire.

Trudy Smith said her son is autistic and that he’s been bullied in the past, including having a tooth broken and being urinated on. But she allowed him to attend a sleepover thinking that he and the 13-year-old boy who lived there would be the only kids there. Turns out there were 14 children there.

Whalen says that after he went to sleep that night, he woke up in pain.

“I went to sleep. (The) next thing I smelled something good then I felt something burning then I smelled something good again and then I felt fire,” he said.

Turns out someone thought it would be hilarious to douse Whalen with cologne and then light him up.

With his shirt on fire he ran to get help, falling down the stairs and setting the carpet on fire. Adults in the home doused the carpet with water, and according to Whalen, he was doused with Dr. Pepper.

According to Smith, police are charging a 13-year-old with aggravated assault and his mother with reckless endangerment. Smith says she was interviewed by DCS and was surprised to find she could be at fault.

“They’re looking into a lack of supervision charges against me, for allowing my child to spend the night at a friend’s house,” Smith said.



This is very very disturbing what those children did.

That's an understatement. If a 13 year old is capable of doing this to another person, I wonder what he'll be like by 21.
 
Wait.... charging HIS mom? Not okay! Charge the mom of the kid who had the sleepover if youre going to charge a parent! This boys mom was trying to let her son have a normal, inclusive life. Its not her fault that kids are assholes! She shouldnt be punished for this she has watched her child suffer enough!
 
Poor kid, getting burned and all that. Why they picking in his mother? Pick on the house owner!! They suppose to be responsible for making sure the kid is safe!!

Agreed. Seems that the victim's mother is hardly at fault here. If the hosting mother is not charged, then why should any mother be charged? When kids do these overnighters, the parents generally ask questions of the host, to determine whether to accept the arrangements. Sounds like the host was deceptive in that a large number of kids showed up.

Wonder if the attackers planned to post video on YouTube?
 
If the person who burned the kid is a minor, there is only so much the law can do with him. The scope of the crime may not be addressed fully.

That's so disappointing! Mother's victim should not to be charged for it. But I'm really glad that victim is doing okay, through he didn't deserve it. *shakes my head*

for cops going this far to charge her... I have a feeling one of the other kids' parent is a cop/DCS/social worker or has a friend.
