Texas Tech required both freshman English courses when I went there. Most schools I know around here require them both.

Evidence is allowed by the judge to trial. People are very rarely handed a death sentence on cases without enough mitigating evidence. Life sentences sure but death sentences go through massive appeals and not enough evidence could be raised...
