Postal Worker Accused of Dumping Mail in Trash

I've heard of delivery drivers dumping packages over the hills so that they don't need to drdrive all the way to the house. And yet on their board it shows delivered to area. I hate those lazy drivers.

If you read history, I still remember back then when USPS experiment with E mail, decided it was not profitable enough so sold to MCI communications (Now its Verizon). USPS didn't have enough patience, they did trial run for 6 months and decided drop it. Because the idea was sold, nothing USPS can do to get it back. Damage has been done. If USPS had patience, and wait for 2 or 3 years, they will see profit right there.

Personally, I think USPS needs to get into email and overnight delivery to a greater extent. Email should be controlled by the government. If you do this, the pay will be more representative. In addition, some of our taxes support it.

Yes, it is federal offense. It has not changed. Many thought they were privatized but really still in control of Uncle Sam.

Tampering with mail is a federal crime and fraud risk

Another one, still shows as federal offense crime

What is the punishment for withholding mail from someone who is not a minor but no longer lives at their former address

Another one, shows that USPS is still federal entity which means it has not 100% privatized yet, and it still IS Federal offense.
Does tampering with UPS packages have federal protections like the USPS? - Avvo.com

lol what? you can't even use USPS site for source?

btw - the link on top is referring to identity theft. and this postal worker did not open or withheld the mails. he simply dumped it in the trash.

Right, even if one tampers private mailboxes, it IS Federal offense too.

yes and no. it's a private property too which falls unders state law.

Mailbox vandalism is no laughing matter | Sun PatriotSun Patriot
As mailboxes are considered federal property, it’s a federal offense to damage one.

According to the United States Postal Service, “willful damage to mailboxes or theft of mail are federal crimes [felonies] punishable by fine or imprisonment or both.” Violators can be fined and/or imprisoned for each act of vandalism. In most cases, however, mailbox vandalism cases are treated under state statutes regarding criminal damage to property. Jason Kamerud, Chief Deputy of the Carver County Sheriff’s Office, said most typical mailbox vandalism cases involve misdemeanor offenses, punishable by up to 90 days in jail and/or a $1,000 fine.

Federal law title 18, section 1708 covers stolen mail. Punishable by up to 5 years in jail. I would think one could argue that he stole the mail as he kept it from being properly delivered.

got proof? that's the argument his lawyer will have.

Jiro, keep in mind, any activity that involves interstate, federal government usually takes over, mean states can't do anything. The reason behind this is no one can be charged twice for same crime. Because mail usually crosses state lines, two states can not charge one for same crime. This will result federal prosecution.

Same principle, if one decided to kidnap somebody from Massachusetts and brought to New York, then that scumbag got busted, who is going to take over? Its Federal, not state because two states already involved. If crimes commit in same state, and not on federal property, then state is the one who deals with this scumbag.

How do I know? I was busted years ago and got warning and I was told that it was federal offense. It was long time ago, I was teenager that time. LOL

it is a federal offense but it's neither enforced nor prosecuted. as posted above - most offenders will be charged under state law rather than federal law for damage to private property.

yes. that's why mail fraud has the harshest penalty and it's vigilantly prosecuted.

but a mailbox vandalism? a federal crime? :laugh2::laugh2::laugh2:

Ask you again, did these mail EVER reach the mailbox?

The mailman didn't deliver to mailbox but to dumpster and the dumpster is NOT a mailbox.

and....?

he didn't keep the mails for himself, didn't he? he didn't open these mails for himself, didn't he?

You forgot I was charged, and I paid fine. Since I was teenager so they gave me stern warning that next time, I will be handled in federal court. I never repeat that.

Mailbox vandalism is somewhat different, because it locate in one state, and nothing from other state then state can handle them if they wanted to.
hence..... it's a state issue, not a federal issue.

But tampering the mail itself is STILL federal offense no matter what.
right.... that's what I said several times......

And you forgot, these mail never reach the mailbox, it was on the hands on federal property.

Yes, I received a visit from USPS LEO after neighbor complained to USPS that I gave unopened mail because USPS worker delivered at wrong address. That happened when I was 17 years old and they questioned if I steal mail from them so I said no because USPS worker delivered to wrong address, even my parent side with me. They said it is federal crime to steal the mail as used to teach a lesson to me.

no you were not charged. you got warned.

and it appears that their empty threat worked on you

Remember age do makes difference. If I get busted right now then I am screwed with federal not state.

no you were not charged. you got warned.
