An Idaho judge is threatening a deaf man with a contempt charge for refusing to make his deaf daughter use her cochlear implant. Shaun McLaughlin isn't making her wear the external portion of the implant when she's with him, so Orton Miller went to court to force him to do it. A judge signed an order requiring the girl to wear the external portion during waking hours because doctors told the mother this will improve her speech.

(I see why he posted it -- the blog has today's date, so it "looks" current.)

Anyway, being FORCED to wear it ? Ouchie.

Why would a Judge force his daughter to wear CI during waking hours, if he does not know about deafness? He goes along with the daughter's mother and her grandparents who are all hearing. They don't know one thing about deafness at all. The father (Shaun) is paying attention to her needs. But the Judge was not paying any attention to her needs, just like her mother and grandparents. They want her to hear everything like a hearing person.

She wanted to be like her father to be free to choose whatever she decide to wear CI or not. Like being comfortable and free to make a choice, not force. This is her ears which is part of her body, not the parents or the grandparents. That is why we need parents to pay attention to their needs when she is trying to explain or crying to let the hearing parents know that she is not comfortable where the hearing parents expect her to do what the hearing parents wants. She had to suffer because of it. It is exactly the same at the mainstream schools and possibly some Deaf school years ago with no ASL and we are being forced to do what the hearing parents and hearing society like AGBell Organization wanted us to do. The word "forcing" is wrong. :(

First: how old is the child?

Second: how did the parents decide to get an Implant for their child in the first place? If THEY decided how can they "alter" how their child should "get used to using " an Implant?

aside: I understand babies/young children born Deaf have Cochlear Implants to "assist in "learning to speak". Normally not exactly a "quick learning experience"?

Third:one can wonder about the ongoing relationship between the "Deaf husband" and the "Hearing wife" can continue to subsist- given the fact of having a court decision re;"leaving their child's Implant on"?

Fourth: no comments on grandparents-offering their "two cents" to the situation.

She has two, and she likes one of them. The side the judge ordered her forced to wear, she says does weird buzzing and hurts.

The parents don't live together.

thats appauling....i did read in germany that parents are consider cruel if no let children have inplant i not sure if this still the case

Right. I think that was the root of the problem - miscommunication between the parents not living together. :(

It's very old news. I heard about it last year or so through DVTV. The story is that the deaf guy got the hearing woman pregnant and when the deaf daughter was over 5-7 yrs old, the mother's parents wanted CI on her but the deaf father said no so they all went to a court and he lost. Then he was ordered to appear in a court again because his daughter didn't wear CI when she was with him. The judge warned him that he will go to jail if he doesn't comply with a court order. That's fucking crazy. He's required to make sure that she wears CI all the times except bedtime when she stays with him. That is un-American. The judge is a fucking sick communist.

Another "odd" thing. The child has 2 Implants and turns one off-ostensibly due to "noise". Wouldn't the "logical choice" for the child would be to return to the Cochlear Implant section and have them "fix the noisy Implant"?

Wouldn't one "hear" with the other one that is still working?

That would be the logical path, to have one fixed if it is not working right. Might be that there is more to this story than was written.

I am trying to click on quote, not like. Sorry.

Anyway, it does not matter if her one side of CI is noisy, it is still abuse to have her being forced to wear it and she had to suffered from it. It take money to get that fix but that will be up to her mother and her grandparents if they can listen to her about her complaint that she was not comfortable with her one side CI. Only thing I don't like is that she was forced to wear CI all day except at night when she goes to bed. That is brutal and cruel of the Judge to do that. If she does not want to wear it because of that noise that bothered her. She should be able to take it off but no, the judge want her to wear it allllllll day. That make her grandparents happy. Geeze

It takes a lot of money to have 2 Cochlear Implants! Aside: my one Implant costs $55,000. 00 Cdn- 5 years ago-Sunnybrook/Toronto. ( I am well aware -it was covered by OHIP as I fit the criteria) What arrangement the young child's -parent/parents has unstated in the article?

The reason one has their Cochlear Implant on all day is to get "used to sound"-from my direct experience Aside: Mine is on-all the time- except when I go swimming-of course. Unfortunately, it takes a "long time" re: "brain acceptance"- hardly something "cruel".

It was unstated exactly how much hearing she gets with one Implant? Aside: I have only one not two.

There probably is much to the story however it wasn't included in the article. Why excluded?

As the cost - does one have insurance?

Get off your rocking chair. You are full of air.

It has nothing to do with sound. She has the right to wear CI whatever she want to wear it. If she does not want to wear CI all day. Then go for it. This is her body and her ears. She is the one to decide what to do with her CIs, not her mother and not her grandparents. Her father understand and he paid attention to her. He see her what she is saying to him.

Not a "rocking chair full of hot air". Just reading comments.

As to the young child's actual knowledge of her Cochlear Implant-unstated.

If my kids don't want to wear clothes, I don't make them either. If all they want to eat is chocolate, oh sure go for it kids.

Yeah we're just getting one side of the story here, his. It seems to me he has been against it from the begining, and he probably hasn't been shy about his disapproval of the implants when she's with him. Who knows, maybe she doesn't wear them with him to make him happy.

No, she is perfectly happy with one side and always wears it. Something bothers her about the other side. She has stated the problems with it.
