assault and assault with a deadly weapon. robbery and armed robbery. it is distinguished from each other based on one's action and the severity of it.... not one's sexual orientation or skin color or religious belief.

And so is assault with a deadly weapon, and assault in the commission of a hate crime. It is all about action, and what the intent of the person committing that act was at the time. Was it to prevent further abuse (as in the case of domestic violence) or was it to cause pain and suffering based on one's sexual orientation or skin color.

In other words, attacking someone who is no threat to you or your life simply because you don't like their skin color or the way they live their live, and believing you are justified in doing so, requires a degree of inhumanity and delusional beliefs of superiority of self that deserve punishment when used as the motive for a crime.

Have we learned nothing from the lynchings of Black men and boys throughout the South?

Yes, we have. When lynchings of anyone of any color happen, the perpetrators are arrested and tried. If they are found guilty, they are sentenced to punishment. Lynching is no longer ignored like it was in the past.

Jiro, each crime has a requirement of intent. There are different kinds of intent. No crimes can exist that don't require intent.

However you add hate into the equation, it's still what the jury reads that counts.

Judges don't have as much discretion as you think. Judges have special training and are accountable for their decisions via appeal. The only exception I can think of is a family law judge. Lots of discretion.

I said that if mental patients escape from centers that are residential areas, the police and public should be notified immediately.

I said that adults shouldn't be in facilities and programs that were designed and promoted for children.

I said that centers that take in violent offenders shouldn't be set up in the middle of residential areas in close proximity to elder care facilities.

That's ridiculous. Throughout this entire thread I've stated over and over, from the beginning (post #2), that anyone who attacks another person should be fully prosecuted.
