There's no point justifying if or why hearing can talk when driving. It's something they can do, whether you can do it or not you can't pull them down just because they can do this. Some hearing are focused in that they think too much when talking. Some can talk without having to look at their passengers.
It depends on your state laws, as far as I know California has very strict ones. You can't even put on headphones on both ears, it's illegal to have it in both ears and you can get fined or ticketed EVEN bicycling too. But, you can wear it with one ear. (VC 27400)
If a hearing mute person was driving, how about they said you can't sign even if the car isn't moving because he can't talk. Is that fair?
Example: Hearing chefs in the kitchen. They are cutting food on opposite tables. One says "Do they want Au Lait or Vermicelli?" and the other chef says "Hey Giorgio, pass me the alfredo". And they are still focused on cutting their food without looking at each other.
