Any ideas? concerns?
 
She's a lesbian for one. Not any of my business concerning her sexual orientation, but my only concern is her agenda and what beliefs that she holds that could either bring up or bring down our country.

So we need more information as to what her history is and what she stands for in order to further understand what her goals are for this country as being a US Supreme Court Judge. So in this type of job bears a huge responsibility and I only want to be sure that she's fit for the job.

I can imagine with Congress, especially with Conservatives, there's gonna be a long drawn out battle to either confirm or deny her the position. Remember, being a US Supreme Court Judge just about guarantees a lifetime employment and benefits, so it is just a matter of making sure she's entitled to that job rightly.

No judicial experience.
Two years of private law practice.
A year as Solicitor General of the United States.
She is one of the most inexperienced nominees with the least amount of relative experience to the U.S. Supreme Court over the last 50 years.
 
Experience is what I personally look for and what her record stands for. So that's pretty much what I look for as for qualifying for the job. This kind of job is a pretty big deal, so this isn't something to make light of.

William Rehnquist doesn't have judicial experience before enters to US Supreme Court in 1972, of course, he is nominated by Nixon.
 
Why do I get the feeling that some President prefers to push inexperienced individuals into a job that is considered a pretty big shoe to fill in?

Easier to influence a "dumbass" to render a judgment if one has an "agenda"?

I prefer a Judge that has alot of years under their belt as well as Wisdom and Maturity to make the right call in whatever case they'll be overseeing at.

Lack of experience is a concern to me. Her sexual orientation means nothing. Not a big fan of this move. Will be difficult to get her through Congress.

Not to nitpick, but how is someone "pro-abortion" instead of pro-choice? You would be the first person I know that is in favor of the actual procedure. Most people are either in favor of choice, or against it. I will not debate this particular topic.

I just have a bad feeling that a sexual orientation discrimination card will be played on this one.

Race or Sexual Orientation should not be a factor for a job such as the US Supreme Court. But rather that the heart of the character as well as the mind of the individual, namely experience and wisdom to do the job and to know how to rightly divide the word of truth when overseeing cases, criminal or not.

In her testimony during her confirmation for solicitor general, Elena Kagan wrote: “I think a judge should try to the greatest extent possible to separate constitutional interpretation from his or her own values and beliefs. In order to accomplish this result, the judge should look to constitutional text, history, structure and precedent. Relating these views to the position for which I am nominated, I think these kinds of arguments also are most successful in advocacy before the courts in constitutional cases. ... The Constitution generally imposes limitations on government rather than establishes affirmative rights and thus has what might be thought of as a libertarian slant. I fully accept this traditional understanding, and if I am confirmed as solicitor general, I would expect to make arguments consistent with it.”

On judicial activism:

In Ms. Kagan’s written responses to Senate questions during her confirmation for solicitor general, she disagreed with the view that the courts should take the lead in creating a more just society.

On Dont Ask, Don't Tell:

Ms. Kagan opposes the ban on gays serving openly in the military. As dean of Harvard Law School, she barred military recruiters from using the law school’s Office of Career Services. She reversed her decision after the government threatened to enforce the Solomon Amendment, which allows the federal government to withhold money from universities that do not extend the same welcome to military recruiters as they do to other recruiters. In a message to the school, she wrote, “The importance of the military to our society — and the extraordinary service that members of the military provide to all the rest of us — makes this discrimination more, not less, repugnant.” However, during her confirmation for solicitor general, she wrote that because the Supreme Court has upheld the Solomon Amendment, she would “vigorously” defend it against constitutional challenge.

On Second Amendment:

“There is no question, after Heller, that the Second Amendment guarantees Americans ‘the individual right to possess and carry weapons in case of confrontation.’”

On Abortion:

During her confirmation for solicitor general, Ms. Kagan said she would respect laws and precedent regarding abortion rights.

A Supreme Court justice isn't supposed to be "pro" anything other than the Constitution.
 
there are tons of more qualified peope but his is obama's payback and his personal friend,so the american people are force to accept her. there will be no debate on her because the votes have already been decided along party lines and all of us are the worst of it.

Outlaw on GLBT rights, abortion and take a liberties away are violate of constitution, IMO.

The constitution isn't designed for religious and moral, IMO.

But it's wishful thinking. You conservatives have agendas too - you want only justices to be elected that share the same values that you have. The SCOTUS have ignored many popular opinions and voided state laws. Abortion is one of them - conservatives want pro-life judges - and they're already opposing Kagan because she said she'll respect the precedent.

Elena Kagan seems to be a blank page that worries both liberals and conservatives.
