Democratic Party today is nowhere to be similar like in 1960's because many southern states was democrat that runs against black people so they switched to Republican Party after Civil Rights of 1964 has passed. I'm southerner and live in southeast states, of course so I know southern politicians, regardless on democrat or republican, depends on whoever is bigot and racist.

Hate to say, Republican Party isn't perfect either so they lost my respect for some reason and try to avoid to vote them so same applies to some democrat politicians, again, depends on whoever so my views is mostly democrat.

They tried to "avoid the vote" because that's what their constituents wanted. Representing is their job. Even if you don't agree with them you should respect the fact that they are doing their job.

He has been dean of the Senate since 2003.

Just like Republican Party, Democratic Party is divided into conservative and liberal so there is still 1960's democrats in some southern states like Robert Byrd is one of them. I know about democrats that runs in southern states are usually conservative and you could call them as DINO (Democrat in Name Only)

This has been the point I am trying to make. I am not trying to tell you what to think ... I am trying to show you that you should research things for yourself, find out if its actually true, then form an opinion based on fact.

In politics, there is too much BS. Most of it is propaganda. Politicians will ALWAYS have a hidden goal or agenda. It is very important to question what those goals and agendas are and to NEVER take what a politician says at face value.

Check the facts out. Do not rely on "well someone told me so it must be true" to form opinions.

I learn something new everyday and I am wrong a lot too because I can fall into the same trap everyone else falls into. I have learned over the course of time that politicians are liars. All of them.

You just have to take the bad with the good and hope the good outweighs the bad.

I have friends that own their own business'. They dont like the health care bill....

...wanna know why?

Because they fear it will put them out of business.......they will lose their source of income and be in debt.....

and their employees will be part of the unemployment list...

Think about it....

In order to make a profit and pay for insurance, small business' will more than likely try to raise the prices of their products just to make ends meet. Then again, with the high prices, they more than likely will lose customers. If they thought it was worse before because of the unemployment rate, it's going to be even worse now.

Why do people think that small business' are all about taking money when owners have to put it back INTO the business...paying the wages, paying to replace inventory, paying bills to keep it warm, cold and have electricity and TAXES; property tax, income tax, social security tax, oh lets not forget...Property insurance tax....and what if something breaks down? They have to pay for a service to come in and fix it....plus TAX!

My boyfriend worked for a greedy owner. They did not offer benefits, they did not offer paid time off, his bonus' for the years he worked there, they took ALL of it, up to 1,500 of it and sent it to child support when by law they can only take out less than 50% of it. They did not have a set hour per day limit, so sometimes he was working from 9 am til 1 or 2 am in the morning to meet their deadlines, and he was never given overtime. This is working 7 days a week. They did not take out the right amount of taxes so he could get a refund, instead because they did not give enough, he wound up paying federal and state taxes. He and one other were the only employees they had, because they didn't want to pay more than the minimum wage. They overpriced cheap furniture to make more money just so they can live the high life. THAT's greed.

Two....while its good for the low income families to have healthcare....what about those that abuse it?

My soon to be ex hubby is living the life...he receives child support, and Social Security benefits because he has my children and it's not legal custody either. He quit soon as he found out that SSDB is giving the boys money because I am on it. He is living the life he wants to live....everything handed to him on a platter. That's greed and laziness. He is essentially living off the backs of those who work day after day to make money and pay tax, social security and medicaid.

THAT is one of the reasons why our country was struggling with the healthcare portion. Because of some people like him, because of some women who get pregnant just to get more welfare and healthcare so they can go in and get thier pills to feed their fix, buy drugs or do nothing but sit around on their lazy butts all day. I recall meeting a woman who said she was on welfare, her kids were taken from her because of her drug abuse. She made the comment that she could always have more kids and laughed. That's sad.

I've heard stories like this. That is so sad. My ex-sister in law is on Disability for rest of her life, because she has congestive heart disease, and is not even that old. She is almost 30. Before she was put on Disability, her doctors kept telling her constantly to quit smoking, changing the diet, stop drinking alcohol, and stop having children. She still had strong chance to turn it around, but she chose to not follow her doctor's advices. She had another child, and her heart almost gave out, but she is stable now. Unfortunately, she still smokes a bunch of packs, drinks alcohol, and sodas, eats junk food and screws men for the heck of it.

I knew this hearing Canuck friend is jobless and uses his young daughter to get $4,000/month from the Ontario government. He has a computer programming degree, and still likes to gloat about it.

I recently watched Jamie Oliver's Food Revolution, and I was blown away. I thought the school system already made changes on the food guidelines to feed children healthy meals, but instead, who would want to feed pizza to children for BREAKFAST? USDA is one of the factors that lead to obesity. If I have children, I would not let my children eat school lunch. We are aware the schools all over nation are facing major budget cuts, and are in need of lunch fund to feed children healthy meals.

All those stories has nothing to do with healthcare itself but about their questionable choices to rip off healthcare. I remember that Bill Clinton required SSA to crack down frauds and pressuring people to get jobs. I believe it's called Ticket to Work or something.

Then there are the drug users, smokers and alcoholics that can afford their vice but not health insurance. I say if they are getting money for free then test them for everything. It is amazing our government wants to crack down on bailout CEO's because the took government money but they won't crack down on others that get government money. How about some fairness?

Drug users are covered by the ADA. You cannot fire them. The same goes for obese people.

Walmart fires Michigan man for using medical marijuana
BATTLE CREEK, Mich. (WZZM) - Now that medical marijuana is legal in Michigan, can an employer fire a worker who tests positive for the drug?

WalMart says it can, so it did. "I was terminated because I failed a drug screening," says former WalMart employee Joseph Casias.

In 2008, Casias was the Associate Of The Year at the WalMart store in Battle Creek, despite suffering from sinus cancer and an inoperable brain tumor.

At his doctor's recommendation, Casias says he legally uses medical marijuana to ease his pain.

"It helps tremendously," he says. "I only use it to stop the pain. To make me feel more comfortable and active as a person."

During his five years at WalMart, Casias says he went to work every day, determined to be the best.

"I gave them everything," he says. "110 percent every day. Anything they asked me to do I did. More than they asked me to do. 12 to 14 hours a day."

But last November, Casias sprained his knee at work. Marijuana was detected in his system during the routine drug screening that follows all workplace injuries. Casias showed WalMart managers his state medical marijuana card, but he was fired anyway.

"I was told they do not accept or honor my medical marijuana card," says Casias.

In an e-mail from headquarters, WalMart spokesman Greg Rossiter explained the company policy. It states: "In states, such as Michigan, where prescriptions for marijuana can be obtained, an employer can still enforce a policy that requires termination of employment following a positive drug screen. We believe our policy complies with the law and we support decisions based on the policy."

Casias says he never used marijuana before work.

"No, I never came to work under the influence, never," he says. "I don't think it's fair. Because I have a medical condition I can't work and provide for my family?"

Casias has been collecting unemployment compensation since he was fired in November but this week he says he was notified WalMart is challenging his eligibility for benefits.

"It's not fair," he says.

Taking Precautions Before Firing an Employee of Your Small Business
Before you fire someone, you should make sure you have a legitimate reason that is based on fact and documented. If, for example you have proof that the employee showed up late or was absent from work on a regular basis, then you can use time sheets or time cards as documentation should you need to substantiate your decision to fire the employee on the grounds of tardiness or absenteeism. Illegal acts, including embezzlement, stealing or drug use are also valid grounds on which to terminate an employee. Again, you must make sure that you have proof of such activities before doing so.

An employee who is not adequately doing his or her job can also be fired. In some instances it might be appropriate to give the employee an opportunity to improve his or her work. It is also important that you provide clear (and documented) instructions as to exactly what task or tasks the employee is expected to do. Then, if he or she has failed to do so, you have documentation stating that the specific tasks or job requests were not carried out. Consistently poor job evaluations will also indicate that the employee is not performing at the level expected of him or her. However, since such evaluations can be subjective, you may wish to substantiate them further by attaching copies of a time sheet showing lateness or work done incorrectly before terminating an employee based on job evaluations.

Employees are also let go because the company can no longer afford to keep them on the payroll. In some cases such layoffs are widespread and may include entire departments while in other circumstances only a few employees may be dismissed. Be careful. Make sure you can fairly justify why each employee is no longer necessary to the company or why a department has been singled out to be eliminated. You do not want to show any pattern of discrimination, either willfully or unintentionally.

Discrimination laws protect against firing someone because of race, sex, religion, disability, ethnic background or because an individual is over 40 years of age. If, for example, all of the layoffs in the company were of individuals of the same ethnicity, they could file a discrimination suit against your business and potentially win.

When Can You Legally Fire Employees?
Finding out when you can legally fire employees isn't an easy question to answer. Laws and cases have become increasingly protective of employees. Although the "at will" doctrine is still prevalent in many states (meaning that you can freely fire an employee at any time), there are many exceptions. Plus, employees are increasingly suing managers and companies for "wrongful termination," harassment, discrimination, and other reasons.

Employment lawsuits can be nasty and expensive, and they can generate negative publicity for your company. Juries tend to be particularly partial to terminated employees.

So when can you legally fire an employee? Here is a list of some reasons that should generally stand up:

1. Consistent incompetence. If an employee just isn't able to do a competent job, and you have given the employee a reasonable opportunity to succeed, then termination will often be seen as appropriate.
2. Violation of company policy. If you have established clear, legal, and consistent policies, and the employee obviously has violated them in a meaningful way, then termination is appropriate. Violation of antiharassment, discrimination, or confidentiality policies are particularly actionable.
3. Repeated unexcused absenteeism or tardiness. Your company depends on its employees to show up for work and perform their jobs. Continual absence or tardiness jeopardizes the ability of an employee to complete important tasks. If absenteeism or tardiness is continual and unexcused, then termination may be justified. Be careful to investigate the reason for the absences. If they're the result of a medical condition, you may need to accommodate that condition, or at least attempt to do so.
4. Physical violence. If an employee commits or threatens physical violence, you will want to fire him or her immediately. All employees are entitled to a safe work environment, and employers have a duty to take reasonable steps to provide for that.
5. Drugs and alcohol. Depending on the circumstances, being under the influence at the office may be grounds for immediate suspension or termination. Some companies now offer treatment and rehabilitation counseling as an alternative to immediate firing. Conditions caused by the use of prescribed drugs may also require a more tempered response.
6. Illegal acts. If you find the employee committing illegal acts, such as theft or embezzlement, immediate termination is justified. Before you fire the accused employee, however, make sure you know all the facts and have heard the employee's side of the story.
7. Falsified information. Sometimes employees lie on their employment applications or resumes (they list fake degrees or jobs they've never held). When you discover this, and the falsification appears deliberate and material, termination of the employee is usually warranted.

There are other instances when you can legally fire an employee. For example, if the employee has had shortcomings and has been given fair warning of these problems with a reasonable opportunity to respond, then a firing can often be legally defensible.

Note: If you do fire an employee and a lawsuit is brought against your company, you should have adequate backup documentation and proof as to the rationale and reasonableness of your actions. Numerous employee appraisals that show consistent poor performance can be part of the documentation (see the sample employee appraisal form listed on this page).

Ultimately, the safest approach to firing an employee is to make sure you have a reasonable and legitimate business reason — one that you have carefully thought out and adequately documented.

Obesity is much more ambigious though.

You can fire someone over weight. Models who fail to be skinny will be fired.
 
Reasonable accommodation of an alcoholic often consists of offering the employee rehabilitative assistance and allowing him/her the opportunity to take sick leave for treatment before initiating disciplinary action. Even if the employee refuses treatment, documentation which clearly demonstrates repeated unsatisfactory performance must be in place before a termination decision is effectuated. In one recent case, for example, a company was found liable for not offering leave without pay for a second treatment in a rehabilitation program! The judge commented that one chance is not enough, since it is recognized that relapse is predictable in the treatment of alcoholics.

TIP: In another case, the judge outlined a series of steps an employer must take to avoid violating the law which is worth repeating:

•First, offer counseling.
•If the employee refuses, offer a firm choice between treatment and discipline. If the employee chooses treatment, the employer cannot take any detrimental action during the period of the rehabilitation program.
•In case of relapse, do not automatically terminate, but some discipline short of discharge can be imposed.
•Before termination, determine if retention of the worker would impose an undue hardship on the employer. If removal is the only feasible option, the company still must evaluate whether the alcoholic condition caused poor performance; if so, the company should counsel and offer leave without pay first.
•Consider establishing and offering an employee assistance program. Such programs may protect employers from discrimination complaints and should be implemented whenever possible. In some states, notably New York and Michigan, state laws require that an employee's group health plans cover alcoholic rehabilitation programs.
When firing alcoholic workers covered under union collective bargaining agreements, an employer's position is strongest when the company can prove that all employees were notified of rules regarding disciplinary misconduct before accepting employment; that those rules were reasonable; that the company conducted a fair and objective investigation; that the employer first sought or encouraged the employee to receive treatment; that if the employee refused, he/she was given additional warnings before termination; and that the final penalty imposed fit the seriousness of the act(s).
