CHICAGO (Reuters) – Less than 24 hours after the House of Representatives gave final approval to a sweeping overhaul of healthcare, attorneys general from several states on Monday said they will sue to block the plan on constitutional grounds.

Republican attorneys general in 11 states warned that lawsuits will be filed to stop the federal government overstepping its constitutional powers and usurping states' sovereignty.

States are concerned the burden of providing healthcare will fall on them without enough federal support.

Ten of the attorneys general plan to band together in a collective lawsuit on behalf of Alabama, Florida, Nebraska, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington.

"To protect all Texans' constitutional rights, preserve the constitutional framework intended by our nation's founders, and defend our state from further infringement by the federal government, the State of Texas and other states will legally challenge the federal health care legislation," said Texas Attorney General Greg Abbott, in a statement.

The Republican attorney generals say the reforms infringe on state powers under the Constitution's Bill of Rights.

Virginia Attorney General Kenneth Cuccinelli, who plans to file a lawsuit in federal court in Richmond, Virginia, said Congress lacks authority under its constitutional power to regulate interstate commerce to force people to buy insurance. The bill also conflicts with a state law that says Virginians cannot be required to buy insurance, he added.

"If a person decides not to buy health insurance, that person by definition is not engaging in commerce," Cuccinelli said in recorded comments. "If you are not engaging in commerce, how can the federal government regulate you?"

In addition to the pending lawsuits, bills and resolutions have been introduced in at least 36 state legislatures seeking to limit or oppose various aspects of the reform plan through laws or state constitutional amendments, according to the National Conference of State Legislatures.

So far, only two states, Idaho and Virginia, have enacted laws, while an Arizona constitutional amendment is seeking voter approval on the November ballot. But the actual enactment of the bill by President Barack Obama could spur more movement on the measures by state lawmakers.

As is the case on the Congressional level, partisan politics is in play on the state level, where no anti-health care reform legislation has emerged in Democrat-dominated states like Illinois and New York, according to the NCSL.

Florida Attorney General Bill McCollum, a Republican candidate running for governor, said the mandate would cost Florida at least $1.6 billion in Medicaid alone.

All states would receive extra funding to cover Medicaid costs that are expected to rise under the reform, including 100 percent federal coverage for new enrollees under the plan through 2016.

Medicaid is the healthcare program for the poor jointly administered by the states and federal government.

Yep, I kinda figured that the health care plan is gonna be blocked, suspended, on hold, whatever until the elections both 2010 and 2012 has passed.

So the plan that has passed is not gonna take effect anytime soon.

Some of health care bill are in effective after Obama sign into law so some others aren't effective until 2014, such as mandatory insurance coverage and insurance exchange.

No, supreme court could do whatever to block or strike the law in anytime so nothing is suspended or hold until next election.

Biggest issue is mandatory insurance coverage that is in questionable since rest of health care bill looks fine.

Not true. An injunction by an appellate judge could stop the plan the second it is signed. That injunction would put a hold on the bill until the SC decided whether or not to hear it. With 4 suits being filed as soon as the bill is signed it is likely the SC will choose to hear it.

Hold the health care bill until next election or second one by supreme court so that's doubtfully because they will hold until it has rule as constitutional or unconstitutional so strike it down or keep it.

Come on, republicans is failing to have health care reform during GWB Admin in Jan 2003 until Jan 2007 so they aren't earn my respect since they are pro-insurance business and don't care about anybody, even you don't care about me or anybody but yourself and see you as selfish. :roll:

Agreed, supreme court would issue an opinion if violate the US constitution or not.

Yup, I can see more tactics from conservative to against on health care bill so it is just excuses.

Republicans are supposed to have health care reform during GWB Admin before too late so if they did so probably not need any democrats to have set own party health care reform.

Look at HIPAA and modernization of Medicare got bipartisan when republican were majority in congress so any health care bill that written by republican would get bipartisan so easily since democrats are more on their party.

Now, it is too late because it is passed so I guess that supreme court will going strike some of health care bill or not.

I have no idea how the court will rule....they can be pretty unpredictable....Just saying I expect them to rule one way of the other before the mid terms

During the GWB administration, the concern was on making sure that the already rich insurance companies became richer, and the politicians were getting their perks from the lobbyists. No concern for the plight of the American citizen.

GOP gave a plan at the HC summit. I can't speak for the Bush admin since I am an independent and was not a Bush fan......especially in the second term. You have to admit the first term and start of the 2nd was pretty busy. As Jiro pointed out months ago How many presidents have had a Katrina? How many have seen an attack on our own soil? How many have seen three hurricanes hit one state (Florida) in one year? How many have had a Rita? Bush had all of those in a 4 year period. I am not a Bush fan but hard to compare his Presidency to others.
