What's scary about this is that the deaf shopper didnt hear the alarm going off and kept walking out causing the security to tackle him like that. I also think the other deaf person should have backed off instead of trying to get through the other security guy.
 
Should be mandatory that all those systems be equipped with a lighting system as well.

I dunno....since the deaf guy did not run, he was walking out...all the security guard should have done was placed his hand on his shoulder to stop him....if the deaf guy did in fact "run"...then something was up.....
Once at Kmart when I was leaving with my own packages, the alarm went off and I did not hear it (of course I'm deaf)...and security stopped me right outside the door. I had to go back in while they checked my packages....everything was in order and I had my receipt...dunno why the alarm went off!

Then again, if a security guard jumped on me and took me down, I would sue the store and the security guard!...This is outrageous!!

As far as the other deaf guy....he seemed to be trying to help his friend as that security guard looked like he had him in a head-lock that was uncalled for! Looked to me as if the guy was trying to say his friend was wearing contacts??????....Then again, if a security guard had my friend on the ground in a head-lock like that, I would try to help also....This was SO UNCALLED FOR!
 
outrageous...this has happened to a friend of mine before as well and someone who just happened to know ASL who was around informed the security people that she was singing that she was Deaf ...this has happened to me but I was with my mom and they just searched our bags and we were fine...they forgot to scan something to de magnetize it I think a DVD or something...anyway if this DID happen to me you better believe I'd sue the shit out of the store ..those security guards are gonna be in for it i hope
 
Well, my first reaction is anger, of course, just at seeing these insensitive scumbags putting the first guy in a headlock and not even listening to the other and treating him like he's some sort of retarded animal.

But, how can we know if the men really weren't shoplifting? And as RR said, we don't know if he tried to run first or anything before they tackled him.

Lots of unanswered questions, but if it turns out that the deaf guys are innocent and were basically attacked by the security guards, I hope they sue the shit out of this company and bring criminal assault charges against the security guards.

It's a good thing I wasn't there in person. Not sure what I would have done, but it probably would have gotten me in trouble, lol.
 
ya'all - you're way over your head if you think you can sue them. trust me - the judge will throw your case out and you're wasting your money on legal fee.

Yes it's a shitty situation but nobody wins here.
 
That made me sick to my stomach to watch--- I mean what did they think that he stole that made choking him until he was turning purple ok--as if it's ever ok. Not only was his friend trying to help (and was obviously scared) but there were people in the crowd who understood what was going on and yelled out that he was deaf... but the guard kept choking him... WOW

As the mom to a deaf/HoH child that really made me realize even w/his HA's in Adam doesn't hear high pitched noises like those alarms one more thing to worry/think about as he grows up... Why don't the detectors have lights on them like public fire alarms do??

that's up to store owner since the security feature is optional but the store owner must abide by fire code.
 
Last several years ago I had found new shirt with magnetic tags when I purchased it from mall shopping building. I can't hear from alarm booth. No security man caught me. lucky! So I will return it to store and show proof of receipt then remove tag. avoid ink spill on shirt.

What makes you so sure? If the men are innocent, then that was clearly assault and battery, and it took place outside the store.

Sure, if these were police officers of course they would get away with it. We all know that. But these are not cops; they are simply hired security guards, and they do not have any sort of legal protections for inflicting bodily harm. There are lots of cases where stores have been sued when their security guards roughed up shoplifters, even when the the shoplifter was in fact guilty.

Best Buy has a policy to simply let shoplifters run away once they are outside the building in order to avoid conflict and protect themselves legally. Any employee who breaks that rule and pursues a shoplifter outside the building is fired immediately.
 
It was worse than a headlock and the security guy knew that because a choke-hold is a bad gig and easier to control someone but a lot more deadly.
 
Ithink I had the alarm go off once at a kmart when I was leaving. I noticed a lot of people giving me funny looks.
Since I bwas doing nothing wrong I just ignored it and walked out. But security guards are always getting sued for excess force. They get half assed training and big egoes

Bodily harm? Assault and Battery? You might want to look up legal definition on that part. I see no such thing in this case. I see a legal detainment by security guard. Depending on state - there is a liability protection for security guard. Since this took place in California....

(f) (1) A merchant may detain a person for a reasonable time for
the purpose of conducting an investigation in a reasonable manner
whenever the merchant has probable cause to believe the person to be
detained is attempting to unlawfully take or has unlawfully taken
merchandise from the merchant's premises.
A theater owner may detain a person for a reasonable time for the
purpose of conducting an investigation in a reasonable manner
whenever the theater owner has probable cause to believe the person
to be detained is attempting to operate a video recording device
within the premises of a motion picture theater without the authority
of the owner of the theater.

has probable cause to believe the person to be detained is attempting
to unlawfully remove or has unlawfully removed books or library

nondeadly force necessary to protect himself or herself and to
prevent escape of the person detained or the loss of tangible or

Best Buy's policy prohibits the employee from handling security-related issue. That's why the store hires security guard for that purpose. For greater legal protection - they hire specialized security guards - "Loss Prevention"
