Woman Who Sold Sex Toy Has Charges Dropped

DALLAS (Reuters) - A Texas woman charged with violating obscenity laws for selling a sexual toy and explaining to her customer how to use it has had the case against her dismissed, court officials said on Monday.

Joanne Webb, a mother of three and a former schoolteacher in the town of Burleson near Forth Worth, was facing up to a year in jail after she sold a vibrator at a private party to two undercover police officers posing as a married couple.

The case received national attention because it touched off a debate on whether a person should be jailed for selling vibrators to adults.

Johnson County Attorney Bill Moore said in a statement that his office last week asked a judge to dismiss the case in order to prevent the county from wasting resources on it.

Texas law allows for the sale of sexual toys as long as they are billed as novelties. But when a person markets the items in a direct manner that shows how they are used in sex, it is considered criminal obscenity.

BeAnn Sisemore, the lawyer representing Webb in the case, said she has brought a federal suit against Texas officials seeking to overturn the obscenity law. She thinks the pending federal suit, along with public pressure, helped lead to the dismissal in the Webb case.

i find this RIDICULOUS!!!! i dont see anything wrong with having an all women's party with the sex toys if all guests are over 18 and legally an adult -- i think women should be educated on the uses of those toys -- its such a WASTE of legal funds and time to prosecute this case if they continued with the trial! im just glad its been dropped cuz i think its :crazy: to be wasting the funds on prosecuting this! what are ur thoughts to this qq
 
My god.. if the lady is showing it at the private party. its okay.. If she shows it in the public thats different story. But she didnt.. geez... Plus she didnt sell it to under 18 yrs old kids. Its really stupid story I ever heard.. *rme* :squint:
 
It's not whether it was sold in public or in private... she sold it as a "sex toy" instead of "novelty". I've gone to many porn stores and I never see "sex toys" advertised anywhere. It's always "novelties" or "novelty". In fact, I went to the porn store last month and they had a section full of dildos, vibrators, etc. That section was labeled with a huge neon light sign... "NOVELTY".

You know what? This sounds like something I already read last year? Let me do a little research on that.

Yep, I was right! I knew I saw it before! This happened in Texas last December!

Did you know that if you have six or more sex toys (or should I say novelties) in Texas, you can be arrested for "promoting obscene materials or devices"? Damn!

yes u right they would be advertised as "novelty" as opposed to "sex toys" but sheesh i think its ridiculous anyway!

I agree that it's a complete waste of resources in prosecuting that lady for selling it at a PRIVATE party! :roll: Like Licana said -- all were adults and at a private party...that wasn't really THAT illegal. geez..those people who prosecuted that lady, to get a frigging LIFE!
 
Jeez. If that woman's going to sell something as controversial as a sex toy she should have done research beforehand. If i'm going to go out and sell a crack bong, I'm sure as hell going to read the laws regarding selling crack bongs beforehand. I bet you the laws are exactly the same: novelties. This woman is an absolute dimwit, trying to make 1.99 selling dildos under the table. What makes it even funnier is i bet it was used.

[edit] Also, how complicated can a vibrator be? I bet you a three-year-old in Mexico could figure out how to turn a vibrator on in three seconds. She shoulda totally seen the raid coming. Too bad this schoolteacher doesn't do research- talk about irony [/edit]

tsk. tsk. it doesnt matter what your all opinions for this issue, texas made this illegal, and its illegal period. So, let justice be served.
 
Yeah I saw many sex shops along the highway when I was heading to Padre Island. I guess people are desperate for money. sheesh.
