Well, this is going to be a long, long post. Well, I am required to go to court on June 30th because of my three ticket that I recieved when I got pulled over by the cops.
Here is what I wrote to NAD (National Association for the Deaf), it saves me time from typing here all over again, heh.
Here it is:
"Dear Sir or Madam:
I am writing to you that I am informing you of some transportation problem I am currently facing right now.
Last year during the spring season my roommate took me to the road test site in east Rochester to take my driver’s test. Once my roommate arrived on the site, the DMV driver instructor approached to my roommate’s vehicle. My friend got out of the car and tried to explain to the DMV instructor that I am deaf and tried to show him a simple sign language in order for me to understand what he’s saying. Immediately he neglected his request and proceeded to my friend’s car. When the DMV driver instructor got inside my car, I tried to explain to him that I am deaf and all of the sudden he scoffed at me and refuse to listen to me. I fretted; he told me to drive. When I drove, the DMV instructor was speaking so fast that I couldn’t understand what he was saying. I can’t pay attention by reading his lip, it would make things much more difficult for me to drive, and even much more difficult for me to pass the road test. As a result of the road test, I failed. It’s not because of my driving skill that causes me to fail my road test; it’s a matter of communication that causes me to fail my road test.
As a matter of fact, I tried to get an interpreter via Affirmative Action for my road test; they indicated that they won’t provide me an interpreter for the road test because of liability issues. I got really desperate. So I decided to take the road test that I mention above and to no avail it won’t work.
So I decided to purchase a car from my friend, registered it (I registered my vehicle on August, 2004) and I need to use my vehicle because I am a RIT/NTID college student in Rochester, NY. I have been driving with my learner’s permit for quite a while. However, there was a period when my insurance lapsed for a short time- around from October to January- that’s when I got my new insurance from Progressive. However, I was ill-informed by the DMV that my registration was suspended unless I pay $600.00 dollar civil fee or surrender my plates. At first I thought I could pay off the fines, but no, I couldn’t because I need the money for my basic needs and for my survival as well.
On May 25, 2005 I got pulled over by the cops right next to my apartment and I showed him my learner’s permit, unfortunately I left my registration information and my insurance at home. So the police gave me three tickets:
1.Unregistered vehicle: I already registered my vehicle a long time ago, but it’s suspended for 75 days until July 21, 2005. That’s when I can re-register again.
2.Uninsured vehicle: I already have insurance from progressive.
3.Unlicensed operator: I have my learner’s permit. Yes, I did drive on the road alone occasionally, and sometimes with my friends who’s above 21. I felt it is a righteous thing for me to do that because for several empirical reasons:
a. I need to get to school so I can complete my education. I couldn’t reside in the dorm because of my concern if I fail any courses and RIT requires me to leave immediately I won’t have any places to stay because I have no parents/dependants. So if I leave, where do I live? Since I can’t drive, I might as well get a cardboard from the dumpster and sleep with the homeless people. I can’t walk every day 5 miles back and forth to school, it’s considered hazardous to my health and my well being, and the risk walking during the harsh weather and the traffic condition as well.
b. I must use my transportation as a mean of getting my basic needs. If I can’t drive then DMV is denying my survival. I tried to get the bus but they won’t stop where I live. In order for me to take the bus, I will need to walk everyday 2-3 miles back and forth, not to mention harsh weather (i.e. winter time, blizzards, harsh rain, and to name a few). I am sick and tired of relying on my friend for transportation. I demand to get my pursuit of happiness and my freedom granted without any evil hassle and hesitation.
c. I need to use my transportation for medical reasons. Let me put some several scenarios: If I am hurt, or unable to communicate via telephone under any circumstance to retrieve any help, how am I suppose to get to the hospital if I can’t drive? How am I suppose to see a doctor when I am in need? Is it rational that paying outrageous money to the taxi cab in order to arrive to my final destination? Maybe once is rational, but using taxi cabs everyday is paying more than what we are paying for gas in our car. No thanks.
d. To escape from isolation. I am sick and tired of being isolated in my apartment. I WANT TO GET A JOB! But no, I can’t because I am unable to drive daily. It’s merely impossible for me to drive now. I need to get a job so I can make sufficient amount of money for my survival needs. If I can’t get a job, then my education deems pointless and a waste of my life.
I pledged myself to serve what is right under the eyes of the law, but sometimes I need to crack it in order to survive. I have no intention to break any laws, but when it threatens my education and my survival, I must take necessary and appropriate action to serve my righteousness cause. If was unable to drive, then this letter would never had been written. My attempt to redefine what freedom ought to be is futile.
My court is schedule on June 30, 2005 and I need all of the help I can get. I probably won’t have any lawyer to afford. I recently became a member of Pre-Paid Legal service; however they are unable to cover me because I was pulled over on May 4th, 2005. Therefore I wasn’t a member of Pre-Paid Legal service by that time. If I am going to get a lawyer, I would have to pay the lawyer $125.00 per hour, multiply that by 5. Under all circumstance, my budget isn’t suitable under that aspect. My entire budget goes toward mainly for my survival needs. I can’t afford a lawyer on my behalf and how am I suppose to trust the judge on my behalf without a lawyer on my side? Should I have not gotten any lawyer, my innocent could be greatly threatened.
I am urgently asking you to provide me with all of your resources and help- free of charge if I may ask- to enforce the DMV to issue me a license so I can go without any undue hardship. Also, please provide me with a lawyer to defend my cause and my innocent as well.
Alas, I must tell you. If nothing works out, I must rally among the deaf people, not for my cause but for every deaf people; I am doing it for them so it will never happen again in the future. Even if it means inciting a peaceful protest, or if it doesn’t work in under all circumstance, I might have to incite a rebellion and lead a revolution for all deaf mankind. I shall dub this as: Battle for Rochester. Sound odd as it seems, but I shall forge deaf people into a new nation, a freedom where it should have granted to everyone back in 1775. I know I already have insurance from progessive, but I am just concern what will the outcome be if I am found guilty regarding with driving w/o registration and driving w/o a license (I have a learner's permit and I am 23 FYI). I am just reaching in for some help.
DMV view their customer as a major source of revenue income for the government, period. They would do anything to charge you outrageous fees otherwise you won't be able to drive. CAR IS JUST A CAR! I only see insurance as a feasible explaination/reasons in order to drive a car. Registration and license is soley for government purpose, it's just to intrude your privacy. The governemnt just want you to sacriface your rights so they can take control of it. Fuck it, I am not going to give it up. Even if it means to rebel against them for a righteous cause!!!
