Well, this is going to be a long, long post. Well, I am required to go to court on June 30th because of my three ticket that I recieved when I got pulled over by the cops.

Here is what I wrote to NAD (National Association for the Deaf), it saves me time from typing here all over again, heh.

Here it is:

"Dear Sir or Madam:
I am writing to you that I am informing you of some transportation problem I am currently facing right now.

Last year during the spring season my roommate took me to the road test site in east Rochester to take my driver’s test. Once my roommate arrived on the site, the DMV driver instructor approached to my roommate’s vehicle. My friend got out of the car and tried to explain to the DMV instructor that I am deaf and tried to show him a simple sign language in order for me to understand what he’s saying. Immediately he neglected his request and proceeded to my friend’s car. When the DMV driver instructor got inside my car, I tried to explain to him that I am deaf and all of the sudden he scoffed at me and refuse to listen to me. I fretted; he told me to drive. When I drove, the DMV instructor was speaking so fast that I couldn’t understand what he was saying. I can’t pay attention by reading his lip, it would make things much more difficult for me to drive, and even much more difficult for me to pass the road test. As a result of the road test, I failed. It’s not because of my driving skill that causes me to fail my road test; it’s a matter of communication that causes me to fail my road test.
As a matter of fact, I tried to get an interpreter via Affirmative Action for my road test; they indicated that they won’t provide me an interpreter for the road test because of liability issues. I got really desperate. So I decided to take the road test that I mention above and to no avail it won’t work.
So I decided to purchase a car from my friend, registered it (I registered my vehicle on August, 2004) and I need to use my vehicle because I am a RIT/NTID college student in Rochester, NY. I have been driving with my learner’s permit for quite a while. However, there was a period when my insurance lapsed for a short time- around from October to January- that’s when I got my new insurance from Progressive. However, I was ill-informed by the DMV that my registration was suspended unless I pay $600.00 dollar civil fee or surrender my plates. At first I thought I could pay off the fines, but no, I couldn’t because I need the money for my basic needs and for my survival as well.

On May 25, 2005 I got pulled over by the cops right next to my apartment and I showed him my learner’s permit, unfortunately I left my registration information and my insurance at home. So the police gave me three tickets:

1.Unregistered vehicle: I already registered my vehicle a long time ago, but it’s suspended for 75 days until July 21, 2005. That’s when I can re-register again.

2.Uninsured vehicle: I already have insurance from progressive.

3.Unlicensed operator: I have my learner’s permit. Yes, I did drive on the road alone occasionally, and sometimes with my friends who’s above 21. I felt it is a righteous thing for me to do that because for several empirical reasons:

a. I need to get to school so I can complete my education. I couldn’t reside in the dorm because of my concern if I fail any courses and RIT requires me to leave immediately I won’t have any places to stay because I have no parents/dependants. So if I leave, where do I live? Since I can’t drive, I might as well get a cardboard from the dumpster and sleep with the homeless people. I can’t walk every day 5 miles back and forth to school, it’s considered hazardous to my health and my well being, and the risk walking during the harsh weather and the traffic condition as well.

b. I must use my transportation as a mean of getting my basic needs. If I can’t drive then DMV is denying my survival. I tried to get the bus but they won’t stop where I live. In order for me to take the bus, I will need to walk everyday 2-3 miles back and forth, not to mention harsh weather (i.e. winter time, blizzards, harsh rain, and to name a few). I am sick and tired of relying on my friend for transportation. I demand to get my pursuit of happiness and my freedom granted without any evil hassle and hesitation.

c. I need to use my transportation for medical reasons. Let me put some several scenarios: If I am hurt, or unable to communicate via telephone under any circumstance to retrieve any help, how am I suppose to get to the hospital if I can’t drive? How am I suppose to see a doctor when I am in need? Is it rational that paying outrageous money to the taxi cab in order to arrive to my final destination? Maybe once is rational, but using taxi cabs everyday is paying more than what we are paying for gas in our car. No thanks.

d. To escape from isolation. I am sick and tired of being isolated in my apartment. I WANT TO GET A JOB! But no, I can’t because I am unable to drive daily. It’s merely impossible for me to drive now. I need to get a job so I can make sufficient amount of money for my survival needs. If I can’t get a job, then my education deems pointless and a waste of my life.
I pledged myself to serve what is right under the eyes of the law, but sometimes I need to crack it in order to survive. I have no intention to break any laws, but when it threatens my education and my survival, I must take necessary and appropriate action to serve my righteousness cause. If was unable to drive, then this letter would never had been written. My attempt to redefine what freedom ought to be is futile.
My court is schedule on June 30, 2005 and I need all of the help I can get. I probably won’t have any lawyer to afford. I recently became a member of Pre-Paid Legal service; however they are unable to cover me because I was pulled over on May 4th, 2005. Therefore I wasn’t a member of Pre-Paid Legal service by that time. If I am going to get a lawyer, I would have to pay the lawyer $125.00 per hour, multiply that by 5. Under all circumstance, my budget isn’t suitable under that aspect. My entire budget goes toward mainly for my survival needs. I can’t afford a lawyer on my behalf and how am I suppose to trust the judge on my behalf without a lawyer on my side? Should I have not gotten any lawyer, my innocent could be greatly threatened.
I am urgently asking you to provide me with all of your resources and help- free of charge if I may ask- to enforce the DMV to issue me a license so I can go without any undue hardship. Also, please provide me with a lawyer to defend my cause and my innocent as well.

Alas, I must tell you. If nothing works out, I must rally among the deaf people, not for my cause but for every deaf people; I am doing it for them so it will never happen again in the future. Even if it means inciting a peaceful protest, or if it doesn’t work in under all circumstance, I might have to incite a rebellion and lead a revolution for all deaf mankind. I shall dub this as: Battle for Rochester. Sound odd as it seems, but I shall forge deaf people into a new nation, a freedom where it should have granted to everyone back in 1775. New Conglomerate for the Deaf- a better nation, freedom through our inspiration to all. Every man decides for his/her future, not the government. According to Zach La Rocha, “ANGER IS YOUR GIFT!”

I know I already have insurance from progessive, but I am just concern what will the outcome be if I am found guilty regarding with driving w/o registration and driving w/o a license (I have a learner's permit and I am 23 FYI). I am just reaching in for some help.

DMV view their customer as a major source of revenue income for the government, period. They would do anything to charge you outrageous fees otherwise you won't be able to drive. CAR IS JUST A CAR! I only see insurance as a feasible explaination/reasons in order to drive a car. Registration and license is soley for government purpose, it's just to intrude your privacy. The governemnt just want you to sacriface your rights so they can take control of it. Fuck it, I am not going to give it up. Even if it means to rebel against them for a righteous cause!!!

I could offer you advice but you wouldn't like it. :)

I think you got a bad deal from DMV for your test. However, your "letter" seems to be full of whining and excuses. You can't break the law and expect no punishment. You can't drive with a learner's permit alone, you can't leave your registration at home, and you can't let your insurance lapse.

I can't give you legal advice. Only a lawyer can do that. However, I think you might have a case under ADA for getting a terp for your DMV test. Have you gone thru your "chain of command" at DMV? Is there a counselor or ombudsman at the college who can help you? How about VR?

I am not familiar with your state. Is "Affirmative Action" an interpreting agency? What exactly was the liability issue? Most terps I know carry "malpractice" insurance for legal liability. Or do they mean physical liability, as in personal injury due to an accident?

That is a long time to drive without insurance. What would you have done if you had an accident during that time?

Since you couldn't pay the fine, did you surrender your plates?

I don't know about your physical condition. Do you have a medical condition that prevents you from walking? Maybe you are eligible for handicapped bus transportation that will pick you up at the door.

Most people don't use a lawyer for traffic court. Bring your proof of insurance and registration to show the judge. Then, just plead guilty and pay your fine.

Yeah, I did left my registration at home and my insurance as well. Oops, it's just a mistake and I asked the cop if I can walk to my apt and get my information, but the cop wouldn't let me.

The thing is that I need to go to school and I need some method of transportation. The only option I had was driving with my car which is registered, insured, but I only have my learner's permit. I had to go to school and I felt that was the right thing to do.

BESIDES! I can't call my TTY 911 via relay, they don't accept 911 call at all, if I recall it correctly.

About my medicial conditional, I was diagnosed with minor malnorishment and dehyrdation, no, I am not asking to be spoon-fed, or breast-fed. But I am providing my justification why I need to drive. We all need to drive for many reasons. For one, survival needs- everyones need eat, am I correct? So they get in their car and head out to grocery shopping and buy food in order to stay alive. BESIDES, it would create an undue hardship for me to walk 2-3 days with 10 bags of grocery. NO thanks! Also, why would anyone use rip-off taxis for a small amount of distance daily? It almost cost them eqviulant to paying one week worth of gas daily. No thanks! Another thing, the bus doesn't stop near my place and I have to walk 2-3 miles in order to get to the bus. Would it be pleasent walking and slouching in the snow during a snowstorm? It's hazardous to my health obviously. We can't just put laws above our survival. Laws are bound to protect us, but the government view us as a major source of revunes and manipulate the laws to suit their desire. It may not AFFECT you, but it affects both, the majority and the minority.

I may be viewed as a typical rebel with a STUPID cause, but I am not. I am revolting this situation for my cause and for everyone. Besides, I do find it ironic that I NEVER get into any accident, doesn't it mean that I am unable to drive? NO! It proves that I can drive. Second of all, when my insurance lasped, I am not dumb to drive on the street and get into an accident- never happened tho. When I renewed my insurance policy, I got my ass on the road and head to school. I didn't came to Rochester FOR NOTHING! I came there to get my damn education.

Suppose I am the only person in the family and my mother and father have been wiped out. Besides, job is hard to find here at Rochester, no shit! The money I am getting is enough for my survival. As I progresses in my education and my job, then I can afford whatever I want. But for now I am demanding that DMV issue me a license or I will accuse them for denying my survival. I will make this as a feasible explaination.

I am defending my innocent even if I cracked a law, and I don't break a law like other pyschopath does. But I do it for a GOOD REASON! This is my pursuit of happniess and I will not let the government take it away from me. Maybe the government is supplying you SSI to keep your mouth shut, and to prevent a revoultion that the government doesn't want it to happen. I don't know. But hear this, I am sure the government doesn't tell the public everything what they had in their mind. The choice is yours, if you're pleased with everything you're having right now, then be it so. I am very happy for you. But as for me and other deaf people who is in similar situation with me, I fight for their cause. Remember, the law isn't perfect, and if that is the case then America isn't perfect and they won't last for long; empire revolves into a different empire for the time being. Nothing last forever.

I wouldn't be suprised if Boyle gained the power and overthrow ADA. I would pick up my AK-47 and rally among the deaf people to reinstate ADA and provide equal access to all hanicaps.

I am sorry if I go deeper into my feelings, but I am feeling that America is withholding my freedom unless I have decent amount of money to set myself free. DMV outrageously charged me fees and requested another registration for another ripoff fees? You see, you need the CA$H in order to obtain your freedom.

You know, I wish I was born in Sweden so I can get what I needed- free food, medicine, prescriptions, hospitals, and clothes, as long the swedish people pay their hefty taxes, they get what they wanted without any hassle. Sweden is just a glimpse of what freedom oughta to be. Well, maybe socialism is a better way for the mankind. Maybe freedom doesn't fit into the context of democracy? Maybe it should have redefined to socialism?

I suddenly realized that American view us like a credit card number. If you want something from them, pay up front. If you don't have the cash or any kind of monetary value, you're shit out of luck. Well, on the other hand, socialism gives out every basic needs to all mankind without hassle except for paying taxes, which is rational and feasible. Of course, we do pay our taxes, but still we don't get the same benefit unlike the Sweden people do. I think the government made a grave mistake by redefining what freedom means. The goverment only wants to suit to their needs, not the people. However, they don't reveal the information to the public, they kept it confidental. Freedom of Information Act is just an illusion and to keep the public under control, even the media.

Alas, I would say that America is the only place where we AT LEAST can obtain freedom, but not to the full extend. Sweden on the other hand is a glimpse of the future of what freedom ought to be. Remember, this is my opinion- everyone is entitled to their own opinion. Thank you!
 
First, let me say that I am not trying to criticize you. I am just trying to show you the viewpoint that "authorities" will see when they read your letter. They must be very "hard-nosed" about these situations because too many people try to take advantage.

My point was, if you are very, very sick or injured, you are in no condition to drive, so a car won't be any good for you in that situation.

Do you really eat that much food?

I know many people stop at the grocery store on their way home (walking or bicycling), and buy one small bag of groceries each time.

I used to walk to school, to work, to the laundromat, and to the store. My mom didn't have a car (or license), and I didn't have a car for many years. Yet, we "survived". I also rode my bike everywhere.

If it is a "small amount of distance" then maybe you can walk or bike.

Can you buy a moped? Those don't have the same licensing rules or cost.

Not everything in life is "pleasant". Sometimes we have to tough it out temporarily so we can reach our most important goals.

I know that Rochester is very "snowy" but it is not snowy now. Maybe you can walk/bike while the weather is nice, and save that money for your license and car by winter time.

I'm sorry, I am not familiar with the "speculation" program or its requirements. All I can say is, if you want to live in the dorm, I guess you better make sure that you don't fail any courses.

I know many people can't afford college full time. They work all day, and then take one or two evening courses. It takes longer to complete the program but it is an affordable way. That's what I did, too. I attended school part time.

You can "demand" all you want but that will not convince the DMV to issue you a license. You still need to pass the test. I think you have a better case for requesting a new test with a terp or whatever "aids" that will help you in the testing process. But DMV will not just give you a license without passing the test.

I never heard of "cracking" a law. Either you follow the law or you don't.

I am sure that everyone who has ever broken a law believed they did it for a "GOOD REASON". ;)

You can sell your AK-47 and get enough money to pay for your $600 fine!
 
You can try the community service options instead of the fine.

Our agency takes in speeders from the court for community service and we put them in easy adminisrative duties for the full sentence. Last year, our 'prisoners' had a lot of fun serving their sentence at our OC-Fair booth.

in less than 10 years ago, I have no GAS in my car and I had to walk to grocery store from my apartment. I know it pretty long way.

If you leave your Ins and Reg then you broke the law, period.

Cant use the 911 for help.... only emerency.

NAD is not ADA... U should write to ADA office, not NAD office. NAD is for deaf support and action for... like deaf power!

Wrong. You can call 911 via relay. But it is best to contact them directly if the emergency is very urgent. Most 911 dispatch centers are equipped with TTY access. Do not ever use internet relay for 911, though. We have to go through a city and state location program when it comes through IP Relay.
