Parents sue Walmart over kids' bath pictures

Arizona couple accused of sexual abuse after employees find nude photos



PHOENIX - An Arizona couple accused of sexual abuse after taking bath-time photos of their children and then trying to have them developed at Walmart are suing the state and the retail giant.

Lisa and Anthony "A.J." Demaree's three young daughters were taken away by Arizona Child Protective Services last fall when a Walmart employee found partially nude pictures of the girls on a camera memory stick taken to the store for processing, according to the suit.

The Peoria couple's attorney said Walmart turned the photos over to police and the Demarees were not allowed to see their children for several days and didn't regain custody for a month while the state investigated.

No charges

Neither parent was charged with sexual abuse and they regained custody of their children — then ages 1 1/2, 4 and 5 — but the Demarees claim the incident inflicted lasting harm.

The couple is seeking undetermined monetary damages from both Walmart and the state and have requested a jury trial.

Richard Treon, the lawyer for the Demarees, said the images of the girls were part of a group of 144 photographs taken mostly during the family's vacation in San Diego.

There were seven to eight bath- and playtime photos of the girls that showed a "portion or outline or genitalia."

‘Parent's worse nightmare’

"There was nothing sexual about it," Treon said. "This is a parent's worst nightmare."

One lawsuit names Arizona, Peoria and the state Attorney General's Office as defendants, claiming that employees from each defamed them by telling friends, family members and co-workers that they had "sexually abused" their children by taking pornographic pictures of them.

A second lawsuit, naming Walmart as the defendant, says the company is at fault for not telling Anthony Demaree that it had an "unsuitable print policy" and could decide to turn any photos over to law enforcement.

Calls to Arkansas-based Walmart and officials from Peoria and Arizona seeking comment on the suits were not immediately returned Thursday.

That is just ridiculous that taking a bath picture caused that! I think everyone has had a bathtime picture taken of them as a little kid, how is that abuse?
 
Walmart has no CHOICE cuz they want to be on the safe side as possible.

The couple could have bought their own photo printer and saved themselves a big headache when it comes to bathtub pics.
 
Do I dare counting the pics I have as a naked baby?!? Jeesh, so all parents are now thrown into the same basket just because they take pictures of their babies naked?!? :roll: And back in the 70s you HAD to bring pics for processing 'cause there was no such thing like printing your own home-made pics...

Ditto... I remember my family picture album book as when I was few years old kid in the 70's. In there, a few picture of me partial naked in the bath tub goofy and playing around as well as other picture of my sister partial naked too. Back then they had a camera film which had to be processed at the store for developing. They didn't take it seriously and just went ahead to process it and paid for the processed photo.

Today, it all changed and people over reacted as it was child abuse, molestation, so on and call the police on them. In the end the CPS takes the kids away from the family. All over the simple partial naked picture of toddler in a bath tub. It was not showing any signs of bruise or whatnot... today's world is getting ridiculous with the overreacting and accusation that went out of hand. :roll:

So now I have a digital camera and can download it in the computer, but I would just save it in a flash drive instead of hard drive in case if a computer needs repair, or if the hard drive gets fried... they would not go through my files.

Unfortunately, today's world is not the same as the old time which was more flexible and less control. Sadly today, the law has more control of people's lives. :(
 
The parents should use their common senses about it. Nowday that everyone freaks out about the sexual abuse if some naked kids are in it. If the parents are innocent, fine then they should not bring the picture developed there in the first place. =/

off the point, I never forget how 1960's and 1970's that they had their pictures developed at the store when those pictures were totally naked. My friend once showed me that her parents and her parent's friends were naked. I was like "oh my god!". Her parents picture book was hidden for a long time until she found it. hehe that was funny. I can't image that they did have their pictures developed at the store in 1960's and 1970's. hehe
 
Problem solved ? Buy a polariod camera that will print ready in it or get a printer that can develope a pic with a film card that goes with it. Simple. You don't trust people nowdays. I don't trust anyone out there. People are greedy, just lookin' for money.

I am glad all my children are fully grown up. :cool2:

Same in 1980's and early 1990's, my parent is used took picture of me being nude when I was little kid so took to developed at kmart and few drug stores like Eckerd so they have no problem.

Today is ugh, gotta agree with Calvin.

It's their children!! But I agree, they should have printed from computer as it is not appropriate for other people to see the photos!!

I also have some photos of me in the bath with my sister.... but cannot tell who's who LOL!! mum doesnnt know either....

Walmart is pretty stupid for failing to tell him about the print policy, and yet they started the drama by telling on the police and the child protection services just because of a few nude pics of kids during bath time...well OF COURSE they have to be nude to take a bath...duh. :roll:

As long as there is nothing further than that, then no I dont find it sexual abuse.

No offense but...fuck walmart. Always causing shit over stupid stuff as a few photos of naked kids in a bathtub by the parents who adore and love them.
 
My mom took pics of my brother and I running around in the backyard naked when we were toddlers. Guess my mom should have registered as a sex offender. Geez! I took a pic of my daughter naked as a 4 month old baby..shud I turn myself in? I feel sorry for the parents. I think Walmart totally overreacted on this one.
 
My parents took a couple of photos of me as a naked baby and put funny captions on it. They're still running free... so I think they did something right. :P

I agree. We have become hyper-vigilant. I have several photos of my son at bathtime, and some of them are my very favorite photos of him as a toddler. Naked bum and all!:lol:

The idiot that reported this no doubt had a few bath time photos taken of them when they were a kid, too. In fact, when my son was 6 months old, I had photos of him taken at Walmart and one of them was him sitting in an old wash tub with a rubber duck and bar of Ivory soap. They left his diaper on, but he was bare otherwise. And they charged me big bucks for taking that picture!:P

mostly walmart customer have problems with receipe or not they not get refunds for that.

some people got sued at walmart for more reasons and dont judges!!
