Required RFID implanted chip:

Sec. 2521, Pg. 1000 - The government will establish a National Medical Device Registry. What does a National Medical Device Registry mean?

National Medical Device Registry from H.R. 3200 [Healthcare Bill], pages 1001-1008:

(g)(1) The Secretary shall establish a national medical device registry (in this subsection referred to as the registry to facilitate analysis of postmarket safety and outcomes data on each device that (A) is or has been used in or on a patient; (B) and is (i) a class III device; or a class II device that is implantable, life-supporting, or life-sustaining."

Then on page 1004 it describes what the term means in paragraph 1, section B:

"(B) In this paragraph, the term refers to information respecting a device described in paragraph (1), including claims data, patient survey data, standardized analytic files that allow for the pooling and analysis of data from disparate data environments, electronic health records, and any other data deemed appropriate by the Secretary."

What exactly is a class II device that is implantable?

Approved by the FDA, a class II implantable device "is an implantable radio frequency transponder system for patient identification and health information." The purpose of a class II device is to collect data in medical patients such as claims data, patient survey data, standardized analytic files that allow for the pooling and analysis of data from disparate data environments, electronic health records, and any other data deemed appropriate by the Secretary.

um..... *sigh*........ if you actually read the health bill.... you'll see that it's not referring to RFID or microchip or anything like it at all. It's talking about implantable device such as Cochlear Implant, pacemaker, bionic leg/arm, etc.. which are Class II and III medical devices.

In this health bill - there's not a single word "RFID" or "Microchip" or anything related to it at all. If you do find it - please point it out for me including page number. Please do that for me.

This bill did have a wording "postmarket device surveillance" but it has nothing to do with big brother monitoring you. It's a registry database for FDA in collaboration with hospitals, physicians, patients, scientists, and even lawyers to ensure patient safety, medical oversight (to prevent fraud), and progression in medical technology. Currently - the database is maintained by private corporations or hospitals. There's no transparency and there's no way of knowing if the medical sector is up to something shrewd especially if they're covering up because the patients died due to defective product.... thus the purpose of this federal medical database maintained and monitored by FDA.

The Internet is great for sharing information. The problem is, it's often false information that gets spread—perhaps more quickly than accurate information.

I recently saw a blog post headlined "RFID microchip included in Health care bill. Since it appears to me no one in Washington has a clue about RFID, I was intrigued and clicked on the link.

The post said "human microchips" (I didn't know chips could be human) are included in the health-care bill (it didn't say which one) under the Sub Title C-11 Sec:2521, which creates a national medical device registry. The blogger writes: "This is the begining (sic) of tracking all movements that you personaly (sic) make, it will also have all your records and will allow the government up to date data to just what you are doing and where you are at."

Wow! Scary stuff.

I did a search for "Sub Title C-11 Sec:2521" on Google, and found many posts essentially saying the same thing. I also found the text of both the House bill and the Senate bill, and there is no "Sub Title C-11 Sec:2521."

There is, however, a section on a national medical device registry (Sub Title C, Section 2561), which reads: "The Secretary shall establish a national medical device registry (in this subsection referred to as the 'registry') to facilitate analysis of postmarket safety and outcomes data on each device that (a) is or has been used in or on a patient; and (b) is...a device that is implantable, life supporting or life-sustaining."

So basically, the bill put forth by the U.S. House of Representatives wants to track the results of these devices and link them to a registry so a doctor looking to implant a device in a patient can check whether it actually worked in previous patients who received the device. There is no mention of RFID, and no mention of tracking individuals who receive the device.

I'm not sure if bloggers simply can't read, or if they are using this kind of misinformation to scare people on purpose. Either way, it's an unfortunate part of the Internet that we just have to accept. I do find it ironic that some of those who oppose RFID because they claim it will be abused are themselves abusing the openness of the Internet. Oh, well.

Jiro, before you pat yourself on your back a little too hard and strain your arm at the same time consider that in 2004 the FDA approved an RFID implantable device called "Verichip" for storing medical records. This device was classified as a Class II medical device.

the implantable microchip are focused on patient identification in emergency situations (i.e. Health Link) and the management of remains and evidentiary items (i.e. VeriTrace).

FDA approval in no way implies mandatory implantation for all Americans. To even imply such is absurd. Nor does the health care bill provide for such.

This is virtually no different from the centrally stored records kept by MedicAlert. Those records as well are intended to identify patients and compromising health conditions in an emergency when the patient themself cannot respond. MedicAlert has been in use for many. many years. The only difference now is in the technology. And just as registration with MedicAlert is voluntary, so will the use of the VeriChip be voluntary.
