If they still had the bird and did not release it then I can see them getting a citation. But since they have let it go and she reported that she did to Fish and Wildlfe. Let it go!! The lady did what she suppose to do.. she rescued and released the bird.

They could have gotten a warning not a stupid fine. They just didn't know about it. They are pretty harsh.
 
I learned that woodpeckers are protected when I had to do something about the holes they created on my mobile home. I bought an owl with bobbled-head that turns in the wind. I think it solved the problem.
