A Stellarton woman is appealing a recent court decision which dismissed her lawsuit against the former Amherst School for the Deaf or Atlantic Provinces Special Education Authority.

Jane Suttis’ case was dismissed last month on the grounds that the expiry of the limitation period had run out. The ruling judge in the case, Justice Gregory Warner, said there was no evidence to support the school had covered up allegations of sexual and physical abuse. Warner said that excluded whether or not the victim in the case was actually abused.

A notice of appeal was filed with the Nova Scotia Supreme Court by Roch Longueépeé on behalf of Suttis and her daughter, the alleged victim, Jennifer Ann Cooper.

Longueépeé, who is an advocate and specializes in the area of institutional abuse, said the problem with this case is the lack of experience in both the courts and systems of governance in effectively dealing with institutional child abuse.

“There is no question in my mind that these two individuals have suffered greatly,” Longueépeé said. He said he and his organization, Restoring Dignity, is “committed to ensuring we avail ourselves in whatever way we can, to see that justice is served in their case.”

The abuse in this case is alleged to have occurred between 1979 and 1984 when Cooper was a student at the former school.
