A deaf teacher of American Sign Language accused of sexually assaulting a deaf former student has been sentenced to one year in jail - six times the sentence recommended by prosecutors.

"I've adopted a one-year sentence instead of 60 days because the victim was very vulnerable and somewhat naive and he was a registered sex offender," 4th District Judge Lynn W. Davis said in sentencing Roger Alan Wilkins, 38, of Lehi.

Wilkins pleaded guilty in November to two third-degree felony counts of attempted forcible sexual abuse. In return, prosecutors dropped other charges, including two first-degree felony counts of attempted rape and forcible sodomy.

Third-degree felonies are punishable by a maximum sentence of zero to five years in prison.

Davis said Wilkins held a prominent position of trust in the deaf community violated that faith when he abused the female student. Not only was the student victimized, he said, but also her mother, Wilkins's wife and children, the deaf community and the community at large.

Davis was appalled that Salt Lake Community College and Utah Valley State College had employed a registered sex offender.

"That is beyond the belief of this court," he said.

According to police, the then-18-year-old victim was befriended by Wilkins as a student at Salt Lake Community College. He invited her to live in his home with his wife and children when she needed a place to stay.

She said that on Jan. 5 and Jan. 9, 2004, he touched her after she had repeatedly said no.

His attorney argued previously that Wilkins believed the incidents were consensual. Prosecutors said the woman told Wilkins no several times, both using sign language and by shaking her head.

Davis expressed great compassion and concern for the victim and her mother, who were present in court.

He said that though the young woman was intelligent, a presentencing report indicated her emotional and maturity levels were that of a 12-year-old girl.

"I can't remember receiving a letter from a victim in the last 19 years on the bench that has been so heart-wrenching," Davis said.

The victim told the judge she's struggled in the two years since the crime and said returning to school and normal life has been difficult.

"I feel lost and overwhelmed," she said through an ASL interpreter. "I'm afraid to enter into a new relationship with a man, afraid for my future. I'm just very afraid."

Davis allowed Wilkins to have work release from jail so he can operate a business selling products on eBay out of his home.

Wilkins also will have to pay a yet-to-be-determined amount of restitution to the victim and her family for counseling expenses.

He also will have to complete sex offender treatment and register with the state as a felony sex offender. He has been listed on the Utah Sex Offender Registry since a felony conviction on two counts of lewdness with a child in a 1993 case.

Davis restricted Wilkins from accessing any pornographic media saying that it was his impression that a pornography addiction was "the genesis" of Wilkins' sexual crimes.

Wilkins expressed remorse to the victim and to all those he had hurt.

"I've been considering the wrongs I've done and I accept full responsibility," he said though an ASL interpreter. "I ask for forgiveness ... and want to never repeat this act."
 
what what???? WAIT A MIN!!!!!!!!!!! 1 yr for sexual offense? and hes a registared sex offender? what;s this world coming to! omg im appalled by this! if hes been registared and voilated this HE SHOULD have more sentence than ONE YR! OMG this is suckable!

LEHI — An American Sign Language instructor who taught part time
at Utah Valley State College and Salt Lake Community College —
and is a convicted sex offender — stands accused of
sexually assaulting a SLCC student.

Roger Alan Wilkins, 37, was arrested
at his Lehi home Tuesday and booked into jail for investigation
of rape, forcible sodomy and two counts of forcible sex abuse
in connection with alleged incidents that occurred on
Jan. 5 and 9. Charges have not been filed and bail for Wilkins
was set at $75,000. His next hearing is scheduled for March 10.

According to police, Wilkins allegedly developed a relationship
with an 18-year-old female student at SLCC. He met the woman
last fall at SLCC, and the two started communicating
through e-mail and a phone for the hearing impaired,
said Lehi Police Sgt. Jeff Swenson. Both the woman and Wilkins
are hearing impaired.

Wilkins persuaded the woman to leave her mother's home and
not tell her mother her whereabouts, according to court documents.
The woman lived with Wilkins and his family for about
month, court documents state.

"He had a position of trust with her and he lured her into
his home," Swenson said. "He used that as an advantage.
He had other intentions with her."

The mother of the woman became concerned when
she learned that Wilkins is a registered sex offender,
according to court documents. Wilkins controlled who the
woman talked to and would not allow her mother into the house.

On Jan. 5, while Wilkins' wife was away, he allegedly
fondled the woman's breasts and genital area, though the
woman told him not to touch her. He then took her to
a Motel 6 where he allegedly attempted to have sex with her
even though the woman said no, court documents state.

Four days later, police say, Wilkins again tried to have sex
with the woman. Police said the woman said no but
Wilkins persisted until the woman gave in to him.

On Jan. 14, the woman told police about the alleged incidents.
Wilkins had been teaching American Sign Language classes
at both SLCC and UVSC on a part-time basis since January 2002.
He was dismissed from SLCC on Jan. 26 for
falsifying his employment application,
said SLCC spokesman Joy Tlou.

UVSC officials did not know of Wilkins' firing from SLCC,
said UVSC spokesman Derek Hall. Wilkins had been teaching
at UVSC up until his arrest.
"His on-going status is up in the air depending on the
legal situation," Hall said. "If he's convicted,
it will mean an automatic dismissal."

Wilkins was listed on the Utah Sex Offender Registry in
connection with a charge of lewdness involving a child in 1993.
In 1994, he was convicted of molesting two boys while he was
the director of a summer camp for deaf children,
said Utah County prosecutor Donna Kelly. Wilkins put towels
around the victims' necks, choked them until they passed out,
then molested them, Kelly said.

Last year, the UVSC per- sonnel department received
an anonymous phone call concerning the man's status
on the Utah Sex Offender Registry.

"It was reviewed by the Attorney General's Office,"
Hall said. "Being on the list doesn't warrant action against
an employee. The school decided to inform his supervisors
of his status. There was a more watchful eye on him than
normal with a part-time instructor."

UVSC does not do background checks on all employees.
"It's not a common practice in higher education and the cost
is prohibitive," Hall said. The school has 800 part-time instructors.
"I'm sure this issue (of background checks) will be
discussed at an administrative level," Hall said.

At the time Wilkins was hired at SLCC, there was
no procedure for background checks on potential employees,
Tlou said. Last spring, SLCC began developing a process
to do background checks on those seeking employment
at the school.
