A former naval officer charged with assaulting his deaf and dumb partner was released on bail in Belfast High Court today.

Brian Smith, 51, of Church Street, Dromore, in Co Tyrone, is charged with locking the victim in her own home and occasioning actual bodily harm during a domestic incident on August 29 2005.

The court heard that police responed to a silent 999 call on August 30 and found the victim in a distressed state.

She was removed from the situation and then taken to hospital for treatment.

A defence lawyer pleaded that alcohol had been involved in the incident and that the victim had "no small problem with alcohol".

Smith was released on his own bail of £250.

Mr Justice Hart ordered the accused not to go within five miles of the centre of Tyrone.

Smith was also instructed to reside at a hostel in Cookstown, report to police weekly, have no contact with the injured party and to avoid alcohol.
