Cops: Hingham man hit deaf man, pregnant woman in race attack - Quincy, MA - The Patriot Ledger
A hearing is scheduled for Wednesday, April 13, to decide whether a Hingham man accused of beating a deaf black man and a pregnant woman in a racially-motivated attack should be released on bail.
Timothy Schmitt, 22, of 461 Main St., a Bentley University student, was charged with a civil rights violation with injury; assault with intent to intimidate based on race; assault and battery with aggravated, serious bodily injury; assault and battery with a dangerous weapon (shod foot);and assault and battery on a pregnant person.
Schmitt pleaded innocent at his arraignment at Waltham District Court April 8.
Police Lt. Detective Brian Navin said the black man was severely beaten and was hospitalized. When the victim’s pregnant friend tried to intervene,
Schmitt punched her in the head, according to the police report.
Judge Tobin Harvey ordered Schmitt held without bail until the hearing Wednesday that will determine whether releasing him would pose a danger to
the community.
Schmitt, who is white, allegedly attacked the victim on the Common, near 600 Main Street, at 1:15 a.m. on April 8, Navin said.
“The black male was beaten pretty severely. The doctor stated his left orbital was fractured, had several facial lacerations, and may require surgery to repair his sinus cavity,” Navin said.
“The evidence appears to be, the black man was not involved as far as starting the fight. It appeared to be an incident where the black male did not initiate this fight, nor did he do anything trying to hurt the white male,” he said.
Schmitt fled the scene, but police caught him a short distance away, Navin said.
The alleged victim had been walking to the police station with two friends to report a stolen car, and were cutting through the Common, when Schmitt yelled at them to stop following him, according to the report.
When one of the two friends responded that they were not following Schmitt, but going to the police station, he screamed, “Shut up,” and then punched the alleged victim’s face, the report said.
The alleged victim ran away, but Schmitt chased him across the street, grabbed him, pulled him to the ground and kicked his face repeatedly, the police report said.
As the pregnant woman held her friend back, Schmitt pointed to the alleged victim, who laid bleeding on the ground, and said, “Look what I did to your (racial slur) friend,” the report said.
At that point, the friend was able to pull the alleged victim away from Schmitt, and then Schmitt punched the pregnant woman in the head with a closed fist, the report said.
Upon seeing the police, Schmitt and his friend, who did was not involved in the attack, ran down Main Street, the report said.
At his booking, Schmitt told police he was “the victim of an assault,” provoked by a group, and had been defending himself, according to the police report.
He refused answer detectives’ questions, the report said.
An officer noted Schmitt had a bloody lip, bloody knuckles, and blood spatter on his sneakers, the report said.
The alleged victim told police that he believed Schmitt was drunk and that the attack was racially motivated, and said he had not thrown any punches.
