35-year-old Oswaldo Martinez, charged in connection with the 2005 rape and murder charge of 16-year-old Brittany Binger, may be ready to stand trial.
Nathan Green, assistant Commonwealth Attorney says Martinez, who is deaf and mute, has made an effort toward learning American sign language and can now effectively communicate with doctors and staff at Western State Hospital.
A competency hearing held Monday, the fourth one since the crime was committed, revealed for the first time, any real possibility of Martinez standing trial.
For the next six months Martinez will become familiarized with his attorneys to deem him either competent - or not to stand trial.
The case will be re-examined on November 14.
