Vanguard Online Edition - Deaf and dumb tells court: For nine years I lived with ‘mother-beater’ as wife
A KETU Customary Court sitting at Ogudu, Lagos State, last week, dissolved the marriage between Mr Toniwel Mamughan and former Mrs Lola Mamughan, ordering Toniwel to pay the respondent ( Lola) thirty five thousand naira monthly as allowance.
Toniwel of 15 Olanipekun Street, Ikosi, Lagos, who is deaf and dumb, had, on February 2, 2007, asked the court to dissolve his nine year-old marriage to the respondent, accusing her of using the police to intimidate and arrest his parents as well as threaten his life. He had also alleged that his former wife was fond of using dangerous weapons to inflict bodily injury on his mother, refused to be submissive to him and withdrew the three children of the union from their school without his consent, adding that there was no more love in the marriage.
The petitioner then sought the order of the court to restrain the respondent from further acts of fighting, beating his mother, molestation, intimidation, provocation, using the police to arrest his parents, among others.
During the hearing, one Mrs Rosanah Joseph, who was presented to the court as the mother of the dumb petitioner, served as the interpreter in the court.
The respondent told the court that she was not liable, accusing the petitioner’s parents for being the cause of the problems in their marriage, arguing that her now ex-husband had left the matrimonial home for two years and that hr was prevented from returning to their home by his parents.
Dissolving the marriage, the court observed that a marriage in which communication between parties go through people outside the marriage and witnessed ceaseless quarrelling and fighting, leading to arrest and detention.
