A 77-year old man arrested last week by police intelligence officers has pleaded not guilty to having raped a deaf-mute girl in Caramoran town four years ago.
Composed of lawmen from the Catanduanes provincial police office and the PNP Regional Intelligence Office, the team led by Chief Inspector Alejo Hernandez nabbed Tobias Borbe in barangay Sabangan just before noon of April 11 in connection with a warrant of arrest issued in 2005 by then Regional Trial Court Branch 42 Judge Antonio C.A. Ayo.
Court records state that in December 2004 the Caramoran police filed the case for violation of the Anti-Rape Law of 1997 against Borbe, who allegedly abused the then 17-year old victim in a secluded place in the barangay sometime in December 2003 by threatening to kill her.
In March 2004, the victim’s mother learned from her mother-in-law that the victim was already pregnant, with the latter indicating through sign language that she was taken by the suspect to the place but could not remember the date and time.
The Court issued the warrant of arrest in January 2005 but had to archive the case two months later when the suspect could not be found. His arrest last week led RTC Branch 42 Presiding Judge Genie G. Gapas-Agbada to revive the case against Borbe, who pleaded not guilty during arraignment on April 13 with the assistance of Atty. Vincent Bermas of the Public Attorney’s Office. The victim, who has since gave birth to one more child by another man, was in attendance along with her family.
