Who is a disabled, as far as working goes?

Hello everybody,

as some of you might remember, I am not a US citizen, just a new immigrant of the US, and I am HoH (completely deaf in my right ear, and with a loss of over 90 dB in my left ear). I am currently browsing for job openings in my field (Engineering) and I came across a website (https://www.disabledperson.com/) with jobs listings.

Since I am not familiar with disability & work in the US, can you please tell me if there are jobs reserved for disabled people and if so, what makes you disabled?

In my home country (Italy) there are jobs reserved for disabled people and your disability is ascertained by a medical commission that examines your medical paperworks and "rate" your disability. That rating is very important when looking for jobs for disabled people since some jobs require people to have a disability rate above a certain number. Companies with a staff over a certain number, are required by law to have at least X disables, otherwise they are fined.

I tried to find these answers myself on the forum and the internet, but all I can find are definition of "disabled person" for financial support - which I am not interested into. I just want to know if I can qualify for the job listed on https://www.disabledperson.com/

US don't have like that, but whats difference here is that agencies knows which companies are willing to hire disabled, and ignore companies that refused to hire disabled.

I have multiple disabled, I have permanent disability, also permanent partial Disability as well. Im pissed off that I have double serious disability. Hopefully next hearing will yield some help get me back in shape. I wish I can find fitness partner here in my hometown just to get myself back in shape and fight back permanent partial disability.

Since I am Deaf as primary and permanent disabled, I also have physical disability which can be treated. With that, my job opportunities already restricted. I no longer can sit for too long. I am not sure about just standing up for too long. The only thing that relieves my pain is moving around a lot, with that moving constantly, the pain goes away.

There are many jobs that I have considered, including truck drivers, I realize that it is going to kill me and not worth the risk. So, I don't know really.

Anyone happen to read this and lives in Rochester, NY area and wants to join fitness club or already member of either RAC OR YMCA, please let me know and we can chat on VP and see what we can do. I rather have buddy that knows ASL and have fun together at the fitness center than being alone. I'm currently member of RAC, and can switch to YMCA easily. Sorry, I can't join Planet Fitness, and RIT fitness... too expensive for me. I pay only 25 dollars a year* for YMCA, RAC, Im not sure of other fitness other than Planet Fitness and RIT. Planet Fitness is not certified or approved provider :( PM if interested.

*I paid 25/year, the rest paid by my health insurance company. Normally those must be at least 50 years old or older are qualified, with few small exceptions. I have a exception which makes me eligible... History of family with heart issues.
 
I'm in the same situation. I would not advise going for disabilities help for job search first. While it can help you, it can also stigmatize you as well. You seem to have good command of English.

What about physical therapy? If you are still on worker's compensation, you should be covered.
 
I do heard that before. I have met many many many Deaf people around the world. In fact, they have better programs for people with Disabilities than here in America. BUT when it comes to accommodations, America still better on that one, for instance Relay services, USA is the only country in the world provides that kind of service for people with degrees of hearing loss.

Long story, like recently I mentioned I won the case. That was only two weeks ago, I fought for 3 years, and workers comp carrier kept denied and refused. Now, they are stuck with it. Will go to hearing in September to discuss what they have to pay, what bills they are owed, and pay me back the lost wage. I lost a lot money. Now they owe me money.

It is NOT easy as you think it is. Some cases are easy to get though, my case is very unique and very hard to prove it is work related injury. Thanks to second doctor that Worker Comp board ordered and forced them to examine my case last March, ended up second doctor blamed on work that cause injury. Before that, since carrier denied my case, causing many of doctors refused to treat me... Why? M O N E Y. My health care insurance refused to cover due to believe it is work related.

Again, it is a long long story. That is how I ended up have better understand of legal bullshyts.

I blamed on Insurance carrier for screwing with me to begin with. They refused 3 years ago, and continue to refused. My previous employer did try everything they could help me. I have a lot respect for my previous employer and I hope they realize that I have no intention to sue them as I know it is NOT their fault, I just simply want to sue that stupid insurance carrier company and make them cough up money for my physical therapy that I needed, plus cover specialist. If had worker comp carrier approved me seeing specialist, they would recommend me not to sit, but to stand up which will help a lot and I will be more likely still work there. This part never happened, and my previous employer decided don't want to hire me out of fear that I will sue them again and that pissed me off. I will be shocked if they re-hire and placed me to different department where they don't require constantly being seated, and I will increase my respect for them.

OK, you won the case so does that mean you are on worker's comp now?

My wife also has the problem with OWCP when she was off work due to work-related injury. The problem is that OWCP paid her about 1/4 of her regular pay for a year. Even though she goes back to work now, she's fighting for what she is owed. She will have a shoulder surgery next month since she still complains about the pain. She's scared because it's a risk.
 
The decision on whether it is work related or not has been made that is all. The decision had decided that it is work related. That is all I know, and yes that means I won the case against workers comp.

Remember, any legal procedure, you don't know everything at once, it takes time for one to find out this part, and wait another period of time to find out what else.

I already mentioned next hearing next month, that is when I will find out more.

I have talked with people that went though same as mine, some not long, while few I know still dragging even after 4 years. One of AD members here have very similar case as mine, he is still waiting and it has been 4 years!

Workers comp is one of most complicated legal system. Once you get hit, depends on the case, if your lucky it is common case, then it is faster, but if it is unusual case, it will drag you forever.

Perfect example, Jodi Arias, is the court over? She was found guilty, right? But what about sentence? Not yet... Same principle.

I do agree that the USA have a better attitude toward disabled people - relay service for one.
What I wrote about the share of disabled employees in the Italian companies, it often turns out that they prefer to get fined than hiring a disable. Or they find a ploy such as hiring consultants... whose sole job is to work for them.
 
Where are you with this? Did you find a job in the U.S? Have you moved here? Please give us an update. :wave:

I haven't yet found a job in the US nor relocated. I am really crossed on what I should do first. I have been contacted for a couple of position in the US, but nothing came out of it (when I emailed back to express my interested in the position, nobody ever replied).
Aside from that, the job market in Italy is getting worse and worse and my push towards the US is growing stronger and stronger.

Hi, there are some employers who for compliance reasons need to hire people with disabilities. Many of those employers post their jobs on our site as a means to finding workers with disabilities. We are referring you to the Americans with Disabilities Act. It will answer all of your questions. You can find the information at ADA.gov homepage. Good luck!

I gotta check out the ADA website to find out if I can self-declare myself a disable or if I need a medical certificate, first.
