What if it was in USA? Would trucking company have to shoulder the blame??

A Chinese truck driver managed to collapse a bridge after driving his overloaded lorry across it, leaving him with a $25 million bill for the repair work.

The man named locally as Mr Zhang was driving a truck filled with sand, that weighed so much, the concrete bridge he was crossing collapsed.

According to Mr Zhang’s local government, blame has been placed solely on him, meaning he has to pay for the repairs – a whopping $25 million.

The China Car Times said: ‘On July 19th of last year, a 34-year-old trucker who has only been named Mr Zhang by Chinese media sources was trucking sand across the outskirts of Beijing.

‘His 110 ton truck caused a bridge to collapse. After a year long investigation the courts have come to the decision that the blame is solely on Mr Zhang’s shoulders due to his overloading ways, My Zhang’s defense so far seems to be that he was just doing what he was told by the trucking company.

‘It’s unclear how, or even if, Mr Zhang is able to pay his 156 million RMB but we suspect the bailiffs will have a hard time collecting.
 
unlikley he owned the truck and i bet he was under certain constraints of his employers to deliver on time and how much..seems unfair

Incorrect - It is 100% driver's responsibility to ensure that:

1. his load limit is safe and legal for transport.
2. the route he takes is safe and legal for his load.
3. the content he is transporting is safe and legal for transport.

most likely by his company, insurance, etc..... or never.

If they follow the "honor" system as they do with families, the driver's family will probably end up having to cover his dues when he dies... until it's all paid off.

thing is , legal limit doesnt exist in Chia, truck drivers dont decide whats to transport , its the fucking company he works for !

so , no, your americanised ideas does NOT apply there

In some bridges, especially old one, overweight could lead to weaken the structure that enable the bridge to collapse.

That will be hard to do as some companies are using ingredients from China to made their products right here in USA. You will have to read the labels to see when the ingredients come from.

yes the bridges have collapsed in America. Remember Minneapolis Bridge Collapse? and Harp Road Bridge in Washington?

every bridge and building has a legal limit. otherwise why would there be a court to hold him responsible for going over weight limit?
 
If the trucker was sent to go from point A to Z and if the way he was going cross the bridge is the only way or the best way, it is not the trucker fault but the company who sent him to is at fault for the blame.
 
And it can also be blamed by the inventor of the bridge or the city engineer not annually check for that bridge which may not only be the trucker's fault as well.

it doesn't matter if it is the only way or best way. you should not be driving over the bridge beyond its legal weight limit otherwise... why would you risk destroying the only way or best way?

that would not be in company's best interest to do that.
 
I've seen many semi's or large trucks trying to go under a bridge or underpass that clearly states the height limit...and get stuck!..And signs are posted...same as for bridges for weight limits....Same as for some car washes (and a friend got stuck in one driving a camper)....:giggle:

A trucking company should know the routes their drivers are taking, the weight and heighth limits for all bridges....so it's my opinion the Trucking company should be responsible, not the driver....unless the driver knew he was not supposed to have taken that route or driven over that bridge with excessive weight.

If, in fact, the driver was "at fault" then he should be fired....but the Trucking Company should have to foot the bill, because he was just an employee., not the owner of the truck and not the one who overloaded his rig.....

in some of the cases those height limits were posted years before. if a trucks height is say 12'8" and the bridge has a height limit of 13'. if that road has been repaved multiple times of the years the posted height is not accurate and the truck gets stuck.

many times the driver uses bad judgement or the driver is a dipshit. :lol:

weight limits are also often old and the bridge may also need to be fixed.

a overpass bridge on part of the PA turnpike NE extension (476) had a chunk of the overpass fall onto the roadway below. happened just a few months ago. caused emergency shut down and detours for travelers on the turnpike.

going over limits for height and weight does fall on the drivers responsibilities. if the driver is not sure, take a different route.

fining this guy in article, 25 million, is just stupid.
