CHARLESTON, South Carolina (Reuters)--South Carolina's House of Representatives approved on Tuesday a comprehensive illegal immigration bill that would allow police to ask for citizenship documentation from anyone they stop or detain for another reason.

It would also allow police to hold a person who fails to provide documentation until their citizenship status is determined.

The Republican-controlled House on Tuesday night voted 69-43 to approve a Senate bill and added amendments. The Senate must concur. If it does not, a conference committee will reconcile the two houses' differences.

The South Carolina law also calls for the creation of a special Illegal Immigration Enforcement Unit within the state police department to work with federal Immigration and Customs officials.

The law would make it a crime to travel within the state without proper documentation or to transport or harbor any undocumented person within the state. It also punishes employers who hire undocumented workers.

"It has become abundantly clear that if we want something done about illegal immigration, we're going to have to do it ourselves," House Speaker Bobby Harrell said.

"This bill gives our state's law enforcement officers another valuable tool to use in the day-to-day fight they wage to enforce our immigration laws."

During debate on Tuesday, Democrats questioned the cost and constitutionality of the bill.

"If you happen to have an accent you're going to be subject to this," said Democratic Representative Joseph Neal. "How long can you hold someone on the side of the road while you check their legality? What happens if you hold somebody for hours because you can't get a response from the federal government?"

"South Carolina is too determined to be locked into the Republican national agenda," said Democratic Representative David Mack. "I believe this bill is racist, it's mean and it's punitive."

Georgia passed an illegal immigration bill earlier this month. Utah passed comprehensive immigration in March that was blocked by a federal judge. Alabama, Oklahoma and Texas are considering immigration legislation this session.

Arizona-style laws have been rejected or failed to advance during the 2011 legislative session in California, Colorado, Iowa, Kansas, Kentucky, Mississippi, Nebraska, New Hampshire, South Dakota and Wyoming.

Good luck because illegal immigrants will flee to other states so won't work at all.

It is better for federal (ICE) to handle and more funds are needed.
 
just like the good old days where blacks are pulled over and mistreated.

Wait a minute!! Doesn't a cop ask everyone for their DL or ID when they are pulled over or stopped??

What's gonna happen when some dude who is overly impressed with the power that badge gives him (and God knows there are plenty) pulls over a Mexican American born in this country and asks for citizenship papers?

But one would think running an ID/DL number would tell you if they are or not.

Driver License does not prove your citizenship status. Just that you have a home address and driving privilege.

Basically.... non-citizen people will now have to carry 2 IDs - Driver License and Green Card (or any other form of documentation). I am not in support of this law for 2 big reasons.

1. a blatant violation of Constitutional rights and overstepping its state authority
2. this is nothing but a financial burden and bureaucratic headache for the state and local police officers

One would think. But what of the cop who says, "I don't think this is a valid DL. Let me see some papers." He would be perfectly within his legal right.

And it would not be the first time a Caucasion cop with a chip on his shoulder has decided to shake down a person of color.

Who is the cop to judge what race a person is??? :ugh:

My daughter is caucasion... Some people thinks she is Mexican. :ugh: Because she tans good and has brown hair.

Totally unfair and racial profiling.
 
plus - this law is unnecessary. The most logical and cost-effective way to combat this is to improve its DMV system.

Simple - implement a new system, technology, or whatever to prevent a production of fake ID/DL and also to effectively verify the authenticity of one's information such as SSN and home address. Add some fancy hologram or whatever. Make it easier for police officer to check the authenticity.

No one gets a SC drivers license or ID card without proof of citizenship. If the person stopped has a valid SC drivers license or ID card, then that's all they need for proof. The police don't ask for "papers."

If the person that's stopped as a suspect in a crime, and they don't have an ID card, then the police can investigate further. They must have probable cause to stop someone in the first place.

No, because they'll only be checking on people they stop for other probable cause or traffic violations.
