Postal Service says it’s immune from local traffic laws

A government lawyer’s attempt to get dismissed nearly $700 in traffic tickets given to the U.S. Postal Service is being met with a hearty and humorous, Heck no.

In a Jan. 22 letter sent to both the city of East Cleveland, Ohio, and the company that operates the city's photo-enforcement program, Postal Service attorney Jennifer S. Breslin says two school-zone speeding citations and five red-light infractions by postal trucks in December should be ignored.

“In providing mail service across the country, the Postal Service attempts to work within local and state laws and regulations, when feasible,” wrote Breslin, after reminding “To Whom It May Concern” that postal workers promptly deliver over 200 billion pieces of mail annually.

“However, as you are probably aware, the Postal Service enjoys federal immunity from state and local regulation,” she continued.

That last bit did not go over well with American Traffic Solutions (ATS), the Arizona-based company that enforces East Cleveland’s camera citations.

“By attempting to hide behind an immunity claim, you are aiding and abetting your drivers in their blatant disregard for the traffic laws in East Cleveland, which have endangered other drivers, pedestrians and school children,” ATS attorney George Hittner wrote in his three-page response to Breslin, who received it on Thursday. (He also cc'd the postmaster general, two U.S. representatives and two senators.)

Hittner cited the Postal Service’s own safety manual and case law to point out that postal truck drivers should and have been held accountable. He also gave a few examples where the driving habits of carriers resulted in well-publicized legal consequences.

“My last and favorite example is of the USPS truck driver delivering mail while naked,” Hittner wrote. “He was arrested for lewd and lascivious behavior.”

He added, more sternly: “We suggest that you transfer the liability for the infractions to the USPS drivers who incurred them, and instruct them that pursuant to Ohio law, as well as the USPS guidelines, the infractions are their responsibility. If you choose to ignore the infractions, penalties and fines will continue to accumulate.”

He then offered a revision of the post office creed:

“Neither snow, nor rain, nor heat, nor gloom of night, nor traffic lights stays these couriers from the swift completion of their appointed rounds.”

Breslin was out of the office on Friday. A colleague said Hittner’s letter was received, but declined to comment.

Now we know why business is slow. People will decide to go to Fed Express and UPS. Plus cost of mailing from post office has went up. Last week.

I hope that they have to pay for the tickets.
 
I believe this goes back to the early days of postal service when it was indeed a serious offense to do anything that impeded the delivery of mail. Even as recently as when I took my driver's exam (1973), one of the questions was, who had the right of way, a USPS vehicle or a fire engine with its lights on--the answer was, the USPS vehicle. Of course, practically speaking, a mail truck would yield to a fire engine but the law was, USPS took priority.

I think the law was originally established that way because highway bandits would hold up and rob mail carriers. Also, more government business used to travel by mail so anything that impeded with that was also a serious offense. (Hence the laws pertaining to congressmen being able to travel without being stopped for traffic infractions.)

It's refreshing to see common sense application of the laws take place. :)

Personally, I think the fines should be paid out of the drivers' pockets.

Hmm, if those drivers would get away from paying fines, then definitely turbocharge all those USPS vehicles. I'm sure that those people who gets my items off E Bay will be thankful for fast service and give me good feedbacks :).

Seriously, bus drivers do have to pay their tickets if they go fast. If bus drivers have to pay for tickets, so should USPS employers(drivers).
 
They should pay the fines IMO. ...what next?...How about those Truckers speeding along the highways? (Especially at night)....Always breaking the speed limit to get their load to the destination on time....and those City Buses!...those big-arsed Buses at times stop right in the middle of the road.....someone did say that whenever a City Bus stops, all traffic is required to stop behind it,,,,,I disagree. For school buses, yes, traffic both ways has to stop. But for City Buses?
 
Here in Chicago, traffic doesn't stop both way for city bus. School bus, yes. City bus, no.

Yup, same here and in DC too - the city bus don't stop at same as yellow school bus does.

I could careless about USPS fines, long as they don't put other drivers in danger because traffic cameras aren't reliable or accurate, some of my friends got camera ticket for fail to stop but they did stopped, so due to technical issue, the court dismissed the tickets.
 
Same here. Stop for school buses on two-lane roads, both directions; on multi-lane roads, only in the direction that the bus is traveling; not required to stop for city buses at all.
 
I have never heard of stopping for city buses. :hmm: I did almost get in a wreck thanks to a trolley in Portland once.
 
Huh? This is not true from what u guys say about us. Yes I drive USPS truck everyday. I follow the law and USPS . They are very strict with us the way we drive. We even have postal inspectors stop us and check on us to make sure we do right way. Even UPS and Fed ex drive crazy, I have seen them everyday. By the way UPS and FedEx drop the packages everyday for us to deliver. What s your problem with us? People are crazy out there and they are very dangerous drivers I deal with them everyday for 4 hours on the road. If the speed limit say45 I drive 45 and they keep passes me. Yet I am so tired of people bitching about us. I love my customers and they are good people. I am hoping one day we will not have USPS anymore so u can pay more$ to UPS and FedEx. I am so sick of hearing people complain about us.
