Kentucky clerk refused have same sex marriages license!

Out west the county clerk is an appointed position, not an elected one, so unless KY is different she can be removed without impeachment process.

In KY, impeachment is only one option to remove her from office, not otherwise.
 
I have seen a number of posts (from different people) referring to her as "City Clerk". She is actually a "County Clerk" which is the next larger government division within the state.

She made Christians look bad.

She made the human race look bad ! She wouldn't issue a marriage license to anyone , if we refuse to our jobs at most businesses we're fired on the spot !

Incorrect, imprison her for contempt of court will not remove her from office and she still have name on county website - she is officially clerk of Rowan County.

impeachment is not the only option on the table.

for example - gross ignorance of official duties. unfitness or inability to promptly and properly discharge official duties. official misconduct. criminal charge.

Official misconduct will not remove her from office automatically.

nothing is automatic.... and that's not the point.

it's a ground for removal. I don't care what Professor Gardner said. that's just his opinion. There are always ways to remove her.

I have gut that Kim Davis will be acquitted from misconduct because some jurors are religious and they don't believe that refuse to issue a marriage to gay couples are misconduct.

There is no win situation but lock her up in jail for long time may pressure her to resign.
 
As an elected official, Davis is difficult to fire. Friday’s request for misdemeanor official misconduct charges against her by the Attorney General begins a slow process that could only actually kick her out of office if the state legislature votes to impeach her. She has also risked contempt charges by continuing to refuse to issue licenses in defiance of a court order. If the Supreme Court grants her request from Friday night, it would keep her in office until her suit against Beshear is ultimately resolved — potentially even by The Nine themselves.

See #153 - impeachment is only one option, not otherwise.

The misconduct is leading to impeachment offense but that's impossible because majority of state legislature are conservative Christians, even DEM or GOP alike.

Good luck with jurors - no jury trial is perfect.

It means they are stuck with Kim Davis until she resigns from office.
 
But can't potential jurors lies so they'll get pick ?

It is possible - they could lie and not expose about their true identify.

Also, no wonder about why bad police officers rarely convicted or indicted.

yes possible but the selection process is quite tedious with dozens of questions that can potentially red-flag you and this is a small town where I assume everybody knows each other...

the trial could be moved to a different county or even capital where there is much less bias. who knows.

Move the trial to NJ/NYC and oh wow, she will be guilty of misconduct. :lol:
