BRADENTON, Fla. — A man convicted of having sex on a Florida beach in front of families was sentenced to two and a half years in prison on Monday.

Jose Caballero, 40, and Elissa Alvarez, 21, were convicted in May of two counts of lewd and lascivious behavior in a case that drew international attention for the couple's brazen act. They were videotaped having sex on a Manatee County beach last summer in broad daylight. Witnesses testified that a 3-year-old girl saw them

.Caballero told jurors that he and Alvarez were not having sex and that witnesses were mistaken. Jurors listened to graphic testimony from witnesses and saw a video of Alvarez moving on top of Caballero in a sexual manner in the middle of the day while others watched.

"We are grateful that the state has offered 2 1/2 years," said Ronald Kurpiers, defense attorney for Caballero.

He said Caballero planned to appeal his case. Alvarez, who was recently sentenced to time served, filed an appeal in her case in June.

Prosecutors say they were tougher on Caballero because he previously served eight years for cocaine trafficking. Both must now register as sex offenders.

The Bradenton Herald (http://bit.ly/1cdYW6l) reports the jury found them guilty after deliberating only 15 minutes. The couple had faced 15 years in prison.

"If you think about 2:30 in the afternoon on a crowded beach. It takes a certain type of person to do that in front of children a few feet away," said Assistant State Attorney Anthony Dafonseca.

Prosecutors said it was important that the community knew what wouldn't be tolerated on public beaches.

LOL I know that beach, it's well south of St. Pete. That's dry humpin' pal! But still, in front of families and kids? There are better places for that, c'mon! :laugh2:
 
Wondering if they were drinking Sex on the Beach while they were having Sex on the Beach?.....Anybody in their right sane minds would seem to have more moral than what these 2 did....If I would have seen this...I'd stick an Umbrella up his arse...

Two recent headlines about sex on Florida beaches? Didn't the other couple get much longer sentences? :lol: I can't even make a joke about STDs this time. :P

I really need to visit Florida someday. There must be something about those beaches...

Indeed.
But considering how much it costs (and yes i know money grows on trees in america) to keep someone incarcerated a a year, let alonw over two, i can think of better things deserving that money then this con living free in the tax payers dime.
Id rather those hundreds of thousands of dollors go to well,
How about kids.
Kids programs,
Parks
Children hospitals,
Schools
How about to maintaining the beach?, cleaning the beaches, so on...so forth...
Haveing cons live for free is cool, i guess, but a more proactive approach besides mere jail is the better idea....

It must be awkward that lawyer required Jose Caballero and Elissa Alvarez to describe their action in front of attendees.

I'm sure they did...or covered the child's eyes...believe a Grandmother videoed "the action"....On the same token..."why" should they have to on a public beach?....Isn't it for swimming, family fun...getting a tan...just enjoying the day....Why should anybody have to be subject to 2 morans having sex on the Beach when they should have got a room?....Would you do this?

So even tho' Hoichi thinks there's "nothing wrong with it"????

Twisting it, I see...the video was turned over to the Police...as evidence...

As for not anyone "stopping the humping"...perhaps it made them sick...shocked....and not knowing if the man had a gun or not...(he's very muscular in the pix)....No one goes to the Beach for such drama as this...it would ruin my day.

He got what he deserved...'nuf said!

I not been thrilled if my kids seen it and I don't know why they not constain themselves but 2yrs plus is ott was nan close enough to ascertain it..Maybe they doing more than just straight forward sex if so then you right and lets hope they got sand where the sun don't show
 
you entitled to your views rr don't mean hoichi right the couple obviously very robust..personally I rather not see someone dick waving around on beach with family and I fogot exposing yourself in sexual way is little better than dirty oldman and is against law..thinking it through your point is right..Think hoichi and me thinking of summer of love Woodstock sort of thing

Very common see them at it under pier or behind sand dune but I have big beach and be by chance if see them but under pier cops go down there every so often but bucket of cold water more likely be used...to much paper work for cops to arrest them
