Girl, 14, arrested over nude pics of herself - The Denver Post

TRENTON, N.J. — A 14-year-old New Jersey girl has been accused of child pornography after posting nearly 30 explicit nude pictures of herself on MySpace.com — charges that could force her to register as a sex offender if convicted.

The case comes as prosecutors nationwide pursue child-pornography cases resulting from kids sending nude photos to one another over cellphones and e-mail, a practice called "sexting." Legal experts, though, could not recall another case of a child-porn charge resulting from a teen's posting to a social networking site.

MySpace would not comment on the New Jersey investigation, but the company has a team that reviews its network for inappropriate images. The National Center for Missing and Exploited Children tipped off a state task force, which alerted the Passaic County Sheriff's Office.

The office investigated and discovered the Clifton resident had posted the "very explicit" photos of herself, sheriff's spokesman Bill Maer said Thursday.

"We consider this case a wake-up call to parents," Maer said.

The girl posted the photos because "she wanted her boyfriend to see them," he said.

Investigators are looking at individuals who "knowingly" committed a crime, he said, declining to comment further because the case is still being investigated.

The teen, whose name has not been released because of her age, was arrested and charged with possession of child pornography and distribution of child pornography. She was released to her mother's custody.

If convicted of the distribution charge, she would be forced to register with the state as a sex offender under Megan's Law, said state Attorney General Anne Milgram. She also could face up to 17 years in jail, though such a stiff sentence is unlikely.

Maureen Kanka — whose daughter, Megan, became the law's namesake after she was raped and killed at age 7 in 1994 by a twice-convicted sex offender — blasted authorities for charging the 14-year-old girl.

The teen needs help, not legal trouble, she said. "This shouldn't fall under Megan's Law in any way, shape or form," she said. "She should have an intervention and counseling because the only person she exploited was herself."

So...who was arrested for looking at them?

WOW..another strike for FB. sorry but they are the ones who should be prosecuted. The girl's 14. she wanted her boyfriend to see them..and I bet he did and told alot of other ppl as well. Another case where MOM and Dad are really not paying much attention, and who took the pictures of her? I just really think this child and that's what she is doesnot need to go to jail she needs some counseling...FB is bad news,, sorry I know so many ppl use that site but as I have told you before I had pictures ( decent everyday) of myself show up on another embarrasing site. FB does nothing to protect you. anything you post can be stolen. and now as i have said before i have my uncle who is an corporate attorney watching them, and he told me get out demand all your information and photos be deleted. I did. he has since tolsd me FB plans on allowing 3rd party ( anyone) acess to yur page , even if yo indicated that you want it private. That girl does not need to go to jail, but the person who took the pictures and FB for allowing them to appear need top be prosecuted, and I hope they are!!! Beware...Peace to you all.Midnight

This article was in regards to MySpace, not FB. MySpace does nothing for privacy controls. FB does. For those who cry foul about FB, they are the ones who do not have their privacy controls or third-party access set accordingly. In the 2 years I've used FB, I have had not one iota of problems, and I won't. You can designate not to let any third parties use any information off you; you can specifically control who sees/gets what information from you. And, even if you have set all your privacy controls so that no outsiders can see you, you can still allow access by authorizing third parties, so it's entirely up to the user to be totally responsible by not authorizing that access.

Anyways, the whole thing about prosecuting the 14-year old girl is ridiculous. She was stupid, naive, whatever, to post explicit photos of herself. But on pornography charges? No.
 
There should be a modification in the law so that these kinds of charges don't happen to people like this. This girl probably should do community service, and go to a few counseling sessions... at the most.
 
Here is where I disagree with AlleyCat. Suppose a 40yo man took a photo of a naked 14yo girl and sent it to all his buddies. He can not only be charge with SENDING but also TAKING the photo. However, if the photo is already out there on FB or MySpace, then he can only be charged with SENDING.....and he'll probably have to get in line with thousands of other guys!! Me? I would rather make it a law that socail networks must "tag" (i.e. just like a bar code) posting so that if an illegal one is out there then all copies are removed. Think of it as produces in the store that can be recalled for the right reason to protect the public.

Then that's the issue of the 40-year old man posting, taking or sending it. At 40, he's an adult. A 14-year old is not. The 40-year old knows better. How do social networks "tag" photos that are inappropriate? Of the MILLIONS of FB users, do you think they can check every single profile? No, unfortunately. So a 40-year old man who takes, posts or even ONLY sends photos of explicit underage kids (whether he took the photo or not) DESERVES to get busted. A 14-year old who used poor judgment in posting photos HERSELF -- should she be arrested for pornography? No. Age is a factor here.

at the very most, just counselling or light community services..
she shouldnt be punished for it, but law is law, and the leeway should be given.


one randon thought, for all we know, she wasnt really hellbent to do evil, it just experiementation and exploring herself, but doing it via the new media can not be done without some kind of exposure leadiing to such a reaction in the (ahem) prudish society or so-called 'moralistic society'

poor girl, to me, she was brave, but silly some might say stupid...but then again i wonder that if for her being that young, she may be quite mature for her age but society dont allow for that, but exceptions like movie stars, or etc just another random thought, meh
 
hope i dont get into trouble with my above comment, but like i refuse to 'say the agreeable things' and try be more 'open minded' looking at what other possible way of looking at this situation...and what might be...not saying she should get away with it, but just reminder there is real danger out there, and she should be careful against really dangerous creeps, so to that, to explain why there is law to forbid, its there to protect. So, come back to what this ought to be handled I still agree she needs guidence via counselling, just to educate her, enlighten her what sort of danger she posed herself into. Indeed when she grows older, she will look back with embarrassment and then with bit of a laugh (provided nothing else goes wrong) and learns from it.
 
The pornograhy charges should be dropped, and she should be banned from all social networking sites until age 18, must attend counseling sessions until aged 16, and she should do a research project (an extensive one) about the dangers of child pornography and the child sex-trade industry on social networking sites and make several presentations at schools in her area and must be approved by DCF and child-advocates as informative and accurate. Maybe this will be a real eye-opener as to what she could have very easily gotten herself into.
 
FB bans at least 2,000 accounts per day
 
Dixie, public humiliation isn't going to help her at all.

Didn't say anything about public humiliation, just saying doing an extensive research project and give presentations on the dangers of posting such images on the Internet which is a free-for-all more or less.
 
kids already know what happened. making her do presentations wouldn't help. that's all. she needs counseling and some tight rules.

Yes but there are kids who will still be unaware or believe that it will never happen to them. These presentations might help drive it home that this sort of behavior isn't just indecent, explicit, or lewd, it is also dangerous, especially for girls that can be easily taken advantage of.
 
i just dont think a disturbed 14 year old girl should be forced to talk about that stuff with her peers...i mean...we dont know anything about the boyfriend.
 
i dont think forcing her to do presentation is a good idea either, it is like public shame. She already has it, no need to rub more salt to the wound. Neither banning her outright from any social network (it cant be done - correct me if im wrong there but) surely her account would be wiped, I'd say just straight counselling and some homework with counsellor (and group sessions?) with internet junkies, or porn junkies, or similar. I mean im sure this is more common than we think, only just been reported it doesnt mean its a one-off, also that it shouldnt surprise us at all, the net it FULL of those things, just to go 4chan.com for starters (now I WARN you now before you'd come back biting me saying its a porn site - its not really its an extreme form of piss-take..for net junkies

but um, for her to do homework to do like research and to demonstrate her understanding of the dangers, is all she needs/required from parental, education authorities, nothing more.
