no it means they have been arrested or have a arrest record. police records are subject to public records. anyone can have access to that information.

You are correct. The picture is from booking.
I've always wondered why if a person is found not guilty or innocence why the picture is not immediately destroyed. Just like the O.P. says, people associate the picture to mean guilty. Therefore, for the greater good, I think the picture should be destroyed.

Is it legal for Mugshots.com to post your mugshot online before you go to court for the crime and to charge a fee to remove it?

the thing is if a person has the record on file and is found innocent, that same person may be guilty of a crime later. that record helps police catch them. many criminals evolve into ever bigger douchebags. most rapists start out as peeping toms, fondle in public or stalkers. petty crimals evolve into armed robbers and so on. so those records help police, police...


I hope the spam is removed and this thread can turn into a debate on the subject.

Again, you are correct. But what if the person is innocence this time and never again is charged/booked for anything at all. Should the pic. stay active? I think not.

I think it should. my Dad arrested a man for rape/murder in late 1976 in based on the witness' discription of a scar and fingerprint on record for a guy who only had a record for looting during the Newark riots. that is nearly 10 years apart.

that record helped him ID the perp.

I see your point and agree with you in this situation.
Change it to where the guy was booked, pic taken, charged, taken to court and found innocence because of mistaken id and another man was captured and found guilty of the rape/murder. Should the first guy's pic remain active? I think not.

I believe those that have been found innocent should be put into a seperate non-public record where only law enforcement can view it. if not, clearly label those people as innocent or exonerated.

I agree. It should be immediately expunged if a person was innocent but then... you know how government is. all records are kept and cataloged but unfortunately... it takes quite a bit of money and time to have it expunged.

according to former police officer... simple - don't get arrested. don't get in a situation where you can get arrested.

it existed way before Patriot Act happened. All thanks to J. Edgar Hoover who was very obsessive of record keeping (unhealthy obsession that is....). Patriot Acts only authorized agencies to monitor American citizens and some without warrants and to suspend their Constitutional rights if needed to.... assuming that they're suspected of terrorism.

I'm not saying that it is right but you can usually pay the site to get your mugshot removed from that site.

For people like me this is a great investigative tool. So is Facebook!
