Man Charged With Exposing Lover to HIV

SAN FRANCISCO - A former city health commissioner who allegedly lied to an ex-boyfriend about his HIV (news - web sites) status is the first person charged under a state law against intentionally exposing another person to the virus, prosecutors said.



Ronald Gene Hill, 46, was arrested in Grass Valley, 50 miles northeast of Sacramento, following his indictment by a grand jury last week, said Mark MacNamara, spokesman for the San Francisco district attorney's office.


Hill was being held in the Grass Valley jail late Wednesday on $100,000 bail, said a jail spokeswoman, adding that she was unsure whether he had an attorney. Hill was scheduled to be arraigned in San Francisco Friday, MacNamara said.


It's the first arrest under a 1998 state law making it a crime to knowingly and intentionally expose another person to the virus that causes AIDS (news - web sites).


"Because this is the first case to be tried of its kind, it presents many difficulties, but the evidence to the grand jury was compelling enough to indict him," MacNamara said.


In March 2002, a San Francisco judge imposed a $5 million default judgment against Hill — $2.5 million in damages and $2.5 million in punitive damages — to be awarded to Hill's former lover, Thomas Lister.


Baron Drexel, the lawyer who represented Lister in his civil suit, said Wednesday that prosecutors originally were unwilling to bring criminal charges against Hill, who was arrested Tuesday.


"People lie to each other," Drexel said. "But when it comes to an issue like this, it's not justifiable at any level."


Drexel said Lister had been dating the former health commissioner for about five months and the couple were taking an Alaskan cruise together in July 2000 when he discovered medical records indicating Hill was taking medication for HIV.


The two earlier had discussed their negative HIV status and both agreed to get tested before having sex, Drexel said. Hill told Lister he tested negative.


On the cruise, Lister suffered chills and fever. One of the ship's medical staff asked both men whether they had been tested for HIV. Both said they were negative.


"He went through Hill's things," Drexel said. "Maybe he got suspicious."


After the trip, Lister tested positive, Drexel said. He sued in January 2001.


"I think it took him a while to compute that this guy had lied to him in such a fundamental way," Drexel said, adding that eight months ago, the last time he talked to Lister, he was still healthy and wasn't taking anti-HIV medication.


Hill, who served on the commission from 1997 to 2000, disappeared during the civil trial and Lister never received any money, Drexel said.


My comment: I agreed with the laws. To protect innocent people from giving the fatal infection for cruelty reason. More cautious urself with anyone before go ahead to sleep with.

thats why when i go g et test and get my results At the same time with my partner less risk of being lied to!
 
Yeah, wish there was an easy way to test for HIV/AIDS like those take-home pregnancy tests!

I think it cost about 200.00 i did not pay for it cuz my med card cover it
 
There was a high profile case a few years back with Charles Ssenyonga, he infected several women intentionally with HIV and the sad thing was that he was never formally charged. He died before he was formally charged or even served any time in jail. It was because of Charles Ssenyonga that Canada implemented an amendment called "Health Protection and Promotion Act". This act protects the HIV victims that were infected intentionally, it was because of this act that recently the Toronto police released a press release about Christanan (Chris) Tooriram. Tooriram has been charged with aggravated sexual assault and he has already infected several people with HIV so the Toronto police is making the public aware about what is going on. In Canada, we get our HIV/AIDS tests for free as we have those HIV/AIDS walk-in clinics. We also can get the HIV/AIDS tests from the doctor's office and it's free too because the government covers it.

Yeah, I have heard about that law being in effect at the height of the AIDS/HIV infection. I had some close encounters with a HIV affected partner and he didn't tell me nor use protection. I was livid and panicking about the possibility of me having the infection. Had tests done -- fortunately, the test came back negative and I had a very good talk with him. He apologised about it and he sure got a lot of crap about it from friends...both mine and his. So far, I reckon he's been careful about that -- and does tell his partner and use protection from now on.

I would like to point out that chris tooriram was never charged, all charges were dropped.. it was just an accusation from a lover.. Further, I am not sure where mr freaky got his information, but his comment, and I quote "and he has already infected several people with HIV " is erroneous.

well, its false...I did a google search for someone in my past and found this huge lie... should be deleted..

Show me a news article showing conviction! You think the media would print an article showing that charges against him were dropped???? HELLO!!!!

And show me any news article showing where he infected anyone... this is bullshit.. people writing crap like this should have proof or be shot.. who is the moderator of this site anyways????
 
Good! I'm from San Francisco and I've heard of people knowingly giving their terminal diseases to unsuspecting people. It's horrible! I'm glad this guy is being charged.
 
On the other hand........I do think that there needs to be some sort of way to track down the HIV postive Typhoid Marys, and lock them up so they can't spread the disease. It does seem like there are people who are being totally and utterly irresponsible in spreading the disease.
Maybe if we did something like that, we could REDUCE the rate of HIV infection drasticly.
