12-year-old boy accused of raping and murdering male preschooler

SPRINGFIELD, Mass. (AP) — A 12-year-old boy has been charged with murdering and raping a male preschooler, a prosecutor said Tuesday.

The 12-year-old is not being identified because of his age. He is scheduled to be arraigned Wednesday in juvenile court.

District Attorney William Bennett said 3-year-old Jeremy Rosario Milan died on Dec. 19, two days after being hospitalized with bruises and a head injury.

An autopsy found the younger boy died from blunt-force trauma to the brain. Bennett said Jeremy had been raped at least twice and beaten several times between Dec. 11 and Dec. 17, while he was left in the care of individuals outside his immediate family.

Earlier, the 12-year-old was charged with assaulting the little boy and pleaded innocent in juvenile court. He has been held in state custody since then on $10,000 bail.

Alan Black, the 12-year-old's lawyer, declined to comment.

Under state law, juveniles convicted of murder can be held in state custody only until age 21.

How old was this preschool child?

And how did this happen; Where were the adults if the preschooler was taken care of by an outside his immediate family.

There are some things are being left unsaid, and the story is just confusing to me.

If he is only 3 years old why isn't there no adult watching him? Was it the 12 years old to watch him? Even through 12 yrs old is not a responsible adult.

Did the parents of 3 yrs. old trust 12 yrs. old to look after him?

It is unfortunate that a child had to suffer. He will be in my prayers, and I hope this 12 year old gets the help he needs.

Anyhow, I hate reading stories like this but something that comes to mind is the criticism I received when I talked about tazers and handcuffs used on children. This article goes to show that the 12 year olds of today aren't the same as when I was 12.....

it's true that they don't give out death pentalites to kids under the age of 16. while there's a law in NC saying that if a 16 year old kid murdered someone, he or she would most likey get a death pentality...I think age 16 is still too young, but fuck the state government anyway.
