Employers Can Fire You For Using Marijuana, But Brandon Coats' Case Could Change Ever

I have worked for companies that use hair sample drug tests when hiring. That means you are tested for however long it takes to grow 3/4 of an inch of hair before being hired. Seems a little intrusive but it does weed out the dope smokers.
 
What about people that go into work on prescription drugs that can impair your judgment do they get fire too?
 
Ok first I know nothing about drugs put some in front of me and could not even identify them. Now that that disclaimer is out of the way.

Is medical marijuana always prescribed by only MDs or can other certain people in (or out?) a medical field prescribe them?

Did you realize that when one smokes, they usually get high and stay high from 1 hour to 4 hours (That is just average), but when they piss, it will stay positive for about 3 days. These type of test to detect THC does not necessarily mean that person is impaired, all that they can detect is that you have smoked now or in the recent past (Depending on how much one smoke) For instance if that person works at company, but never smokes until after retiring for the evening on regularly basis, then the THC in that person system will remain detect for as long as a month, up to 3 months from the last smoke, did you realize that?

I support that nobody should smoke during work, but I do not support companies that fires anyone that smokes only at home and after work or "weekends", but the test is pretty much like you are checked for both, at work and at home which is not justifiable.

They would ask you for a prescription to prove that you are supposed to be on that drug. Then, they would ask that you move the time you take that drug to before bed or something. ( Which if you are taking a script that impairs your ability to work, it probably impairs your ability to drive so you should probably be taking it before bed anyway and most doctors would tell you to do this anyway ) :P Topamax makes me groggy, so I take it before bed time instead of before I go to work. Yay, smart decisions! :P :laugh2:

If a job doesn't want people smoking marijuana working for them, they don't want people smoking marijuana working for them... period. Weekends or not, that's their decision. That tells me, they don't want their employees engaging in illegal activities, GOOD FOR THEM! Jobs like the sheriffs office for instance. It wouldn't be very right to have our officers enforcing drug laws that get to go home and toke it up on the weekends back at work during the week telling people they can't do that. They hair follicle everyone here. If you shave your head, they take it from various other areas... including arm, leg, underarm or genital... :laugh2: People think they're crafty eh? If you completely shave, then they wait... it will still grow out in the root... Here in Florida, they can also Saliva test which is even more accurate.

I'm sorry, I don't really care if my cheeseburger maker is toking it up... but I really don't want the man/woman about to stitch my arm back on doing drugs ( including marijuana ) of any sort. mmkay, thanks. I work in triage and I've seen some of the idiots high on pot come in there and I do NOT want that crap working with or around anything to deal with me or anything to do with me. I have friends that smoke it but they know not to do it around me. They also have nothing to do with my money, health, well being, life or anything else involving me living my life. Do it on your time, that's fine. Don't bring it around me or anything to do with me or where I'm going including where I conduct my business... period.

If it is ever legalized, the nice thing is businesses will still be able to have stipulations that allow them to discriminate against it! Just like tobacco here! An employer is allowed to not hire you if you're a tobacco smoker. In the same sense if marijuana is ever legalized here, they'll still be able to drug test you for it and not hire you for smoking it... :D

This is the agency my mother works for in St. Petersburg, Florida. If you select yes ( you've smoked tobacco ) it will tell you, We apologize, but due to the answers you have provided, we cannot proceed with your application at this time. There are quite a few businesses here that do this, not just the sheriffs office. :)

It does bring into question the rights of employers over the rights of individuals. I came up in a different workplace environment. If you did your job well that was the main criteria.
Alcohol use off the job was encouraged. If you were not an alcohol drinker then there was a certain amount of distrust. Men would stop at the bar on the way home and spend money that the family needed. There were stunning examples of long term extreme alcoholism. This was not a rare thing. Even with that these men were often the best of employees. People who take pride in their work will do good work no matter what.

To give the employer the right to be inside my body or any one elses body during the time they are not being paid is to me an invasion of rights worth fighting to the death over. Literally. It is a fundamental thing. The problem for me is that I would be fighting alone. It is hard to get excited about being rubbed out. Choosing battles and enjoying life anyway is kind of a weenie way to live but it does makes some sense.
 
I don't agree. Would you want a high lawyer working your defense case at home? Or a doctor who smoked weed three hours before surgery?

Most employee handbooks say they are a drug free environment. You accept that agreement upon employment. I know many employers that punish their employees coming into work hung over. It does affect your ability to perform your job.

I totally agree with Mew's two posts. Her's are a logic example of why I wouldn't hire people who smell like weed (or any other drugs for that matter).

Exactly my point.... you can flip my cheeseburger, but you're not doing anything important for me.... I'd like that super-sized, please. :D Pay you triple digits to operate on my high... pfffffffffffffft... out of your damn mind....
