A jury in the trial of four men for the rape of a profoundly deaf woman at a churchyard in York has been discharged after failing to reach a verdict.


Leeds Crown Court heard the 36-year-old woman, who cannot speak, was subjected to a "terrifying sexual ordeal" by four men off Micklegate on 13 November 2005.

Marcin Legowski, 23, Dominik Knoblauch, 21, and Cezary Krasnolopski, 26, all of Lincoln Street, York, all denied rape.

Janusz Rucinski, 23, of no fixed address, also denied the charge.

On Thursday, the jury of five women and seven men was discharged by judge Jonathan Durham Hall QC after two days of deliberations.

The defendants are expected to face a retrial at Leeds Crown Court on 5 March 2007.
