Hello all,
I just joined today and need help, I'm in a legal jam and 98% deaf.
I found this site by searching for help with my problem.

In May of this year I had a argument (oral only) with my wife (married 25 years to her) inside our house, she got upset and mad at me and went to police to get a three day order to stay out of the house. We went to domestic violence court and my wife dropped the charge had the case dismissed, but the townships police also made a complaint against me a criminal charge of harrassment (2c 33 4A) my wife wanted this dropped too but we can't have it dropped was a police complaint from the review of the report my wife gave them. I hired an attorney and he told me the prosecutor "might" drop the charge if I start and attend anger management classes.
I been asking all over in my area of Ocean County NJ where are the classes to attend that will suppy me with the needs to understand what they are saying or what online classes are approved in my area courts (the ones I called don't have the equipment to do this).I like to go where they have a CART setup class.
I asked the County courts, the Townships courts, they don't know. I emailed NJ division of the deaf and hard of hearing never got a reply yet.
Does anyone here know where I can get this help in Ocean County NJ?
If I don't get this criminal charge dismissed it will be an arrest record then and I'm having enough problems getting employment now as it is. Court date is 9/23.

I'm sorry this was a long post and I thank you for any replies.

Your attorney should be able to resolve this. If all else fails, you might want to get an interpreter or note taker for the class. You should arrange something asap to show the judge that you're motivated. Good luck.

I thank you sallylou for the reply.

My wife just emailed me and said the Township court adminstrator said they do not accept any online classes for any cases. This leaves me only in-person classes now.
I'm been laidoff over a year now hard to find employment..Most places for in-person classes said same as you..I have to supply my own way to listen/understand the class.
Being unemployed not sure I can handle the cost of 12 classes (lawyer suggested) plus pay for the interperter. Told my wife today if its runs alot of money will have to accept the charge and receive the arrest record for this. Don't think I deserve this but will take it...getting too old now to fight for my rights.

If these classes are offered to the public, then whoever is responsible for the classes is responsible for the terp.

Silent world's attorney should be able to tell him who teaches the classes. There is usually a list of approved courses. He can call the course providers directly.

Again I thank all for replies.

My attorney gave me three places to call for these classes..my wife calls of course.
She talked to two of them the third never called her back..they said he (me) would need an individual class (by myself with some type of way to understand) reason is most have group classes (4-5 persons) and if I had a CART reporter with me (only way I can do it) it would be breaching their privacy (private matters are in discussion even group wise with clients) and the contract states all matters would be private...so that's out..they said I need to locate a one on one class....been searching a few right now..seems this will cost quite a bit to me now a private one on one and CART translator...can't understand why they don't accept online classes...its all tracked and recorded day by day each session and perfect for me to understand.
Well my search goes on..never heard back yet from NJ Division of the Deaf and Hard of Hearing..was hoping they could help me. Thank you all anyway for your help here. God Bless!

You might want to remind those groups that are worried about confidentiality that using a CART reporter does not violate confidentiality as they are bound by the same restrictions regarding confidentiality that intepreters are. I work in the mental health field, and although I am fluent in ASL, I have many colleagues that use terps for both group and individual counseling. It does not violate confidentiality ethics or priviledged communication laws.

Why isn't his attorney up on this? The attorney can call the local bar for more information and resources. Or the County. Is this a small jurisdiction?

I have no idea. Maybe his attorney is not versed on the ADA. Doesn't seem that the groups he contacted are either.

I been in contact with my attorney a few times about this and need to contact him again Monday I'm having problems galore. My wife left message's (phone/voice mail) all last week to two main places in my area (Ocean County NJ not a small area) and no replys up to today Saturday (Perferred Behavioral Health Service and Saint Barnabas Behavioral Health Center will not reply to us...why don't know). As said this is not a court requirement but its a better choice to attend to these classes for a possible dismissal of the criminal charge before my court case and learn to control my stress. Being unemployed I'm worried about the cost of a one on one class and the CART person costs.
I know the court system in my area doesn't accept online classes but was thinking maybe the prosecutor would ( he would need some type of backing up if he dismissed my case) but now after researching the best #1 online anger management classes I found out they just upgraded their online classes to have some video sessions throughtout the course (12 hours) and the video will have audio too ( that hurts my chances of doing it online).
Now I hope two other places I read about for one on one classes will reply to us my only choice I see now, my wife calls from her job and I email.
I'll figure this out sooner then later..have too. Thank you all for reading my problems and help. Will post my final results here..good or bad.

Don't let them get away with not replying, and document all of your phone calls and emails.

I tend to agree with Jillio here. She is offering you some very good advice.

Jumping in late, but, I do not see where having CART in a closed group meeting violates anyones privacy. The CART person would not be running off transcripts of the meeting.

I do not know what state you are in but anything can be adapted and must be if you are required to complete it.

I agree, document every contact you have tried to make regarding this situation.

I don't see how the presence of a terp or CART typist would be a privacy problem. We work in highly sensitive confidential situations all the time without compromising participants' privacy. That's part of the terp ethics. I think the people you are dealing with need a little "educating" about the terp/CART role.

Terps are involved in confidential group meetings such as AA, court appointed defensive driving classes, etc.

If it makes the powers that be feel better, they can request the terp or CART person sign a confidentiality statement that is legally binding. I've done that before.
