No, it's not illegal. IThose policies are not connected with the law; that is, saying "we don't discriminate based on race or gender" has nothing to do with the Civil Rights Act or the Equal Rights Act. Similarly, *not* saying "we do not discriminate based on disability" is not the same as not complying with the ADA, the Rehab Act, etc.
